LONG TITLE

General Description:

This bill supplements or reduces appropriations previously provided for the use and
10
operation of state government for the fiscal years beginning July 1, 2008 and ending June 30, 2009
11
and beginning July 1, 2009 and ending June 30, 2010.

Highlighted Provisions:

This bill:

. provides appropriations for the use and support of certain state agencies;
15
. provides appropriations for the use and support of public education;
16
. provides budget increases and decreases for other purposes as described; and
17
. provides intent language.

Monies Appropriated in this Bill:

This bill appropriates for fiscal year 2009 effective July 1, 2010:

. $80,995,500 from the Uniform School Fund;
21
. ($91,200,000) from various sources as detailed in this bill.

This bill appropriates for fiscal year 2009 effective immediately:

. $45,000,000 as a transfer from the General Fund to the Education Fund;
24
. ($80,995,500) from the Uniform School Fund;
25
. ($126,534,300) as a transfer from the Education Fund to the Uniform School Fund;
26
. $116,700,000 from various sources as detailed in this bill.

This bill appropriates for fiscal year 2010:

. $4,555,000 from the General Fund;

. $2,261,403,400 as a transfer from the Education Fund to the Uniform School Fund;

. $3,133,700 from various sources as detailed in this bill.

Other Special Clauses:
32 Sections 1 and 3 of this bill take effect on July 1, 2009. Section 2 of this bill takes effect
33 immediately.

37 Be it enacted by the Legislature of the state of Utah:
38 Section 1. Under the terms and conditions of Title 63J, the following sums of money are
39 appropriated from resources not otherwise appropriated, or reduced from amounts previously
40 appropriated, out of the funds or fund accounts indicated for the use and support of the government
41 of the State of Utah for the fiscal year beginning July 1, 2008 and ending June 30, 2009. These
42 appropriations net against amounts previously appropriated for fiscal year 2009 effective July 1,
43 2009 in uncodified Section 15, One-time appropriations for fiscal year 2008-09, Chapter 391, Laws
44 of Utah 2009, whereby negating those appropriations.

79 The Legislature intends that the Division of Finance, after
80 accounting for revenue collections that accrue directly to the
81 Uniform School Fund in fiscal year 2009, shall transfer from
82 the Education Fund to the Uniform School Fund an amount
83 sufficient to cover fiscal year 2009 Uniform School Fund
84 appropriations but not to exceed the sum of transfers between
85 the Education and Uniform School Funds contained in all
86 appropriations acts for fiscal year 2009.

91 The Legislature intends that the Division of Finance
92 transfer up to $45,000,000 from the General Fund to the
93 Education Fund in fiscal year 2009 to balance revenue and
94 expenditures in both funds. The Division of Finance shall
95 transfer only as much from the General Fund to the Education
96 Fund as necessary to cover Education Fund appropriations in
97 fiscal year 2009, but shall not transfer an amount sufficient to
98 cause a year end deficit in the General Fund.

235 Section 4. Effective Date.
236 Sections 1 and 3 of this bill take effect on July 1, 2009. If approved by two-thirds of all the
237 members elected to each house, Section 2 of this bill takes effect upon approval by the Governor, or
238 the day following the constitutional time limit of Utah Constitution Article VII, Section 8 without
239 the Governor's signature, or in the case of a veto, the date of override.
