             8      LONG TITLE
             9      General Description:
             10          This bill modifies the Traffic Code by amending provisions relating to reduced speed
             11      school zones.
             12      Highlighted Provisions:
             13          This bill:
             14          .    provides that if a school crosswalk is established at a signalized intersection, a local
             15      highway authority may reduce the speed limit at the signalized intersection to 20
             16      miles per hour for a highway under its jurisdiction; and
             17          .    makes technical changes.
             18      Monies Appropriated in this Bill:
             19          None
             20      Other Special Clauses:
             21          This bill provides an immediate effective date.
             22      Utah Code Sections Affected:

             26      Be it enacted by the Legislature of the state of Utah:
             27          Section 1. Section 41-6a-303 is amended to read:
             28           41-6a-303. Definition of reduced speed school zone -- Operation of warning
             29      lights -- School crossing guard requirements -- Responsibility provisions -- Rulemaking


             30      authority.
             31          (1) As used in this section "reduced speed school zone" means a designated length of a
             32      highway extending from a school zone speed limit sign with warning lights operating to an
             33      end school zone sign.
             34          (2) The Department of Transportation for state highways and local highway authorities
             35      for highways under their jurisdiction:
             36          (a) shall establish reduced speed school zones at elementary schools after written
             37      assurance by a local highway authority that the local highway authority complies with
             38      Subsections (3) and (4); and
             39          (b) may establish reduced speed school zones for secondary schools at the request of
             40      the local highway authority.
             41          (3) For all reduced speed school zones on highways, including state highways within
             42      the jurisdictional boundaries of a local highway authority, the local highway authority shall:
             43          (a) (i) provide shuttle service across highways for school children; or
             44          (ii) provide, train, and supervise school crossing guards in accordance with this
             45      section;
             46          (b) provide for the:
             47          (i) operation of reduced speed school zones, including providing power to warning
             48      lights and turning on and off the warning lights as required under Subsections (4) and (5); and
             49          (ii) maintenance of reduced speed school zones except on state highways as provided
             50      in Section 41-6a-302 ; and
             51          (c) notify the Department of Transportation of reduced speed school zones on state
             52      highways that are in need of maintenance.
             53          (4) While children are going to or leaving school during opening and closing hours all
             54      reduced speed school zones shall have:
             55          (a) the warning lights operating on each school zone speed limit sign; and
             56          (b) a school crossing guard present if the reduced speed school zone is for an
             57      elementary school.


             58          (5) The warning lights on a school zone speed limit sign may not be operating except
             59      as provided under Subsection (4).
             60          (6) (a) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act,
             61      the Department of Transportation shall make rules establishing criteria and specifications for
             62      the:
             63          [(a)] (i) establishment, location, and operation of school crosswalks, school zones, and
             64      reduced speed school zones;
             65          [(b)] (ii) training, use, and supervision of school crossing guards at elementary schools
             66      and secondary schools; and
             67          [(c)] (iii) content and implementation of child access routing plans under Section
             68      53A-3-402 .
             69          (b) If a school crosswalk is established at a signalized intersection in accordance with
             70      the requirements of this section, a local highway authority may reduce the speed limit at the
             71      signalized intersection to 20 miles per hour for a highway under its jurisdiction.
             72          (7) Each local highway authority shall pay for providing, training, and supervising
             73      school crossing guards in accordance with this section.
             74          Section 2. Effective date.
             75          If approved by two-thirds of all the members elected to each house, this bill takes effect
             76      upon approval by the governor, or the day following the constitutional time limit of Utah
             77      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
             78      the date of veto override.
