             8      LONG TITLE
             9      General Description:
             10          This bill modifies the Volunteer Government Workers Act by amending the definition
             11      of "compensatory service worker."
             12      Highlighted Provisions:
             13          This bill:
             14          .    amends the definition of the compensatory service worker to include a person who
             15      is performing public service as a condition, or as part of, incarceration, a plea, or
             16      sentencing; and
             17          .    makes technical changes.
             18      Monies Appropriated in this Bill:

             26      Be it enacted by the Legislature of the state of Utah:
             27          Section 1. Section 67-20-2 is amended to read:
             28           67-20-2. Definitions.
             29          As used in this chapter:


             30          (1) "Agency" means:
             31          (a) any department, institution, office, college, university, authority, division, board,
             32      bureau, commission, council, or other agency of the state;
             33          (b) any county, city, town, school district, or special improvement or taxing district; or
             34          (c) any other political subdivision.
             35          (2) "Compensatory service worker" means[: (a)] any person who [has been convicted
             36      of a criminal offense; (b) any youth who has been adjudged delinquent; or (c) any person or
             37      youth who: (i) has been diverted from the criminal or juvenile justice system; and (ii)]
             38      performs a public service with or without compensation for an agency as a condition or part of
             39      the [person or youth's] person's:
             40          (a) incarceration;
             41          (b) plea;
             42          [(A)] (c) sentence;
             43          [(B)] (d) diversion;
             44          [(C)] (e) probation; or
             45          [(D)] (f) parole.
             46          (3) (a) "Volunteer" means any person who donates service without pay or other
             47      compensation except expenses actually and reasonably incurred as approved by the
             48      supervising agency.
             49          (b) "Volunteer" does not include:
             50          (i) any person participating in human subjects research to the extent that the
             51      participation is governed by federal law or regulation inconsistent with this chapter; or
             52          (ii) compensatory service workers.
             53          (c) "Volunteer" includes a juror or potential juror appearing in response to a summons
             54      for a trial jury or grand jury.
             55          (4) "Volunteer safety officer" means an individual who:
             56          (a) provides services as a volunteer under the supervision of an agency; and
             57          (b) at the time the individual provides the services to the supervising agency described


             58      in Subsection (4)(a), the individual is:
             59          (i) exercising peace officer authority as provided in Section 53-13-102 ; or
             60          (ii) if the supervising agency described in Subsection (4)(a) is a fire department:
             61          (A) on the rolls of the supervising agency as a firefighter;
             62          (B) not regularly employed as a firefighter by the supervising agency; and
             63          (C) acting in a capacity that includes the responsibility for the extinguishment of fire.
