8 LONG TITLE
9 General Description:
10 This bill modifies the Bail Bond Recovery Act regarding use of badges and identifying
11 clothing by licensees.
12 Highlighted Provisions:
13 This bill:
14 . allows licensees under the Bail Bond Recovery Act to display and wear a badge of
15 a design authorized and approved by the Bail Bond Recovery Licensure Board if
16 the licensee also displays lettering on clothing that indicates the licensee is a bail
17 enforcement or recovery agent; and
18 . allows the licensee to wear a distinctive jacket bearing an insignia indicating the
19 wearer is a bail enforcement or recovery agent, if the insignia is approved by the
20 board.

29 Be it enacted by the Legislature of the state of Utah:
30 Section 1. Section 53-11-121 is amended to read:
31 53-11-121. False representation as a licensee -- Badge -- Identifying clothing.
32 (1) A licensee under this chapter may not wear a uniform, or use a title[
33
34 statement that would lead a reasonable person to believe the licensee is connected in any way
35 with the federal government or any state or local governmental entity, unless the licensee has
36 received authorization in writing by one of those governmental authorities to do so.
37 (2) (a) A licensee may possess, wear, and display a badge of a design approved by the
38 board for use by a licensee.
39 (b) The licensee may wear or display the badge under Subsection (2)(a) only if the
40 licensee is also at the same time wearing an article of clothing that conspicuously displays on
41 the chest and back of the article of clothing lettering that clearly identifies the licensee as a
42 bail enforcement or recovery agent.
43 (3) A licensee may wear a jacket of a distinctive design or style that bears a printed,
44 embroidered, or otherwise permanently attached symbol, emblem, or insignia that:
45 (a) clearly identifies the wearer as a bail enforcement or recovery agent; and
46 (b) is approved by the board.
