             7      LONG TITLE
             8      General Description:
             9          This bill modifies the Criminal Code to prohibit the selling of a ticket to a sports or
             10      entertainment event for a price significantly greater than the actual ticket price.
             11      Highlighted Provisions:
             12          This bill:
             13          .    provides that a ticket to a sports, athletic, or entertainment event may not be sold or
             14      offered for sale for more than the price on the ticket, applicable tax, and reasonable
             15      service charges;
             16          .    provides that violation of this provision is a class C misdemeanor; and
             17          .    provides that each separate sale or offer to sell a ticket is a separate offense.

             24          76-10-3001, Utah Code Annotated 1953

             26      Be it enacted by the Legislature of the state of Utah:
             27          Section 1. Section 76-10-3001 is enacted to read:


             28          76-10-3001. Prohibition of ticket scalping.
             29          (1) A person may not sell or offer for sale a ticket or any other license of admission to
             30      any sports event, athletic contest, or entertainment event at a price greater than:
             31          (a) the price printed on the ticket or license of admission;
             32          (b) any applicable tax; and
             33          (c) a service charge that does not exceed the greater of $10 or 15% of the price printed
             34      on the ticket or license of admission.
             35          (2) (a) Violation of Subsection (1) is a class C misdemeanor.
             36          (b) Each sale or offer to sell a ticket or any other license of admission in violation of
             37      Subsection (1) is a separate offense.
