9 General Description:
10 This bill modifies a provision relating to the Utah Public Notice Website.
11 Highlighted Provisions:
12 This bill:
13 . modifies statutory requirements to publish or post notice to the Utah Public Notice
14 Website to provide a temporary exemption for public bodies with an annual budget
15 of less than $1,000,000.

24 Be it enacted by the Legislature of the state of Utah:
25 Section 1. Section 63F-1-701 is amended to read:
26 63F-1-701. Utah Public Notice Website -- Establishment and administration.
27 (1) As used in this part:
28 (a) "Division" means the Division of Archives and Records Service of the Department
29 of Administrative Services.
30 (b) "Public body" has the same meaning as provided under Section 52-4-103 .
31 (c) "Website" means the Utah Public Notice Website created under this section.
32 (2) There is created the Utah Public Notice Website to be administered by the Division
33 of Archives and Records Service.
34 (3) The website shall consist of an Internet website provided to assist the public to find
35 posted public notices of a public body of the state and its political subdivisions as required
36 under Title 52, Chapter 4, Open and Public Meetings Act, and under other state statutes or state
37 agency rules.
38 (4) The division, with the technical assistance of the Department of Technology
39 Services, shall create the website which shall:
40 (a) allow a public body, or other certified entity, to easily post any public notice
41 information that the public body or other entity is required to post under statute;
42 (b) allow the public to search the public notices by:
43 (i) public body name;
44 (ii) date of posting of the notice;
45 (iii) date of any meeting or deadline included as part of the public notice; and
46 (iv) any other criteria approved by the division;
47 (c) allow the public to search and view past, archived public notices;
48 (d) allow a person to subscribe to receive updates and notices associated with a public
49 body or a particular type of notice;
50 (e) be easily accessible by the public from the State of Utah home page;
51 (f) have a unique and simplified website address;
52 (g) be directly accessible via a link from the main page of the official state website; and
53 (h) include other links, features, or functionality that will assist the public in obtaining
54 and reviewing information in relation to public notices posted on the website, as may be
55 approved by the division.
56 (5) The division shall be responsible for:
57 (a) establishing and maintaining the website, including the provision of equipment,
58 resources, and personnel as is necessary;
59 (b) providing a mechanism for public bodies or other certified entities to have access to
60 the website for the purpose of posting and modifying notices; and
61 (c) maintaining an archive of all notices posted to the website.
62 (6) The timing for posting and the content of the public notices posted to the website
63 shall be the responsibility of the public body or other entity posting the notice.
64 (7) Notwithstanding any other provision of statute requiring the publishing or posting
65 of a notice to the website, a public body with an annual budget of less than $1,000,000 is
66 encouraged but not required to publish or post a notice to the website.
