10 General Description:
11 This resolution amends procedures for the appointment of the House Ethics Committee.
12 Highlighted Provisions:
13 This resolution:
14 . amends the Joint Rules to change the procedures for appointing members of the
15 House Ethics Committee;
16 . provides that four committee members be chosen by the Speaker of the House from
17 eight nominees submitted by the House minority leader, and that four be chosen by
18 the reverse process;
19 . provides that the committee select the committee chair from the majority party and
20 the cochair from the minority party; and
21 . makes technical changes.

28 Be it resolved by the Legislature of the state of Utah:
29 Section 1. JR6-2-101 is amended to read:
30 JR6-2-101. Ethics Committees -- Membership -- Jurisdiction.
31 (1) There is established a Senate Ethics Committee and a House Ethics Committee.
32 (2) The Senate Ethics Committee shall be composed of:
33 (a) the chair and three additional members appointed by the President of the Senate;
34 and
35 (b) the cochair and three additional members appointed by the Senate minority leader.
36 (3) (a) The House Ethics Committee shall be composed of[

41 (b) (i) (A) The Speaker of the House of Representatives, in consultation with the
42 majority caucus, shall nominate eight members and submit the names to the House minority
43 leader.
44 (B) The House minority leader, in consultation with the minority caucus, shall select
45 four members, from those nominated by the Speaker of the House of Representatives, to serve
46 on the committee.
47 (ii) (A) The House minority leader, in consultation with the minority caucus, shall
48 nominate eight members and submit the names to the Speaker of the House of Representatives.
49 (B) The Speaker of the House of Representatives, in consultation with the majority
50 caucus, shall select four members, from those nominated by the House minority leader, to serve
51 on the committee.
52 (iii) If a vacancy occurs on the House Ethics Committee for any reason, the vacancy
53 shall be filled for the unexpired term in the same manner as the original appointment, except
54 that the replacement member shall be chosen from three submitted nominees, rather than eight.
55 (c) After the committee is constituted, the Speaker of the House and the House
56 minority leader shall schedule a public meeting of the committee, and at that meeting:
57 (i) the committee members in the minority party shall designate a chair from members
58 of the committee in the majority party; and
59 (ii) the committee members in the majority party shall designate a cochair from
60 members of the committee in the minority party.
61 (4) Members of the [

63 (5) If a complaint is filed against any member of the respective ethics committees, the
64 President of the Senate or the Speaker of the House shall appoint another member of the Senate
65 or House to serve in that member's place while the complaint is under review.
