             8      General Description:
             9          This resolution prohibits the distribution of gifts on the House floor and provides a
             10      process for the distribution of informational and educational items on the House floor.
             11      Highlighted Provisions:
             12          This resolution:
             13          .    prohibits the distribution of gifts on the House floor;
             14          .    provides a process for the distribution of informational and education items on the
             15      House floor by Representatives and legislative staff; and
             16          .    prohibits lobbyists from requesting that a gift be distributed on the House floor.

             25      Be it resolved by the House of Representatives of the state of Utah:
             26          Section 1. HR-22.11 is enacted to read:
             27          HR-22.11. Prohibition of the Distribution of Gifts on the House Floor --


             28      Distribution of Informational and Educational Items.
             29          (1) A person may not distribute a gift on the House floor.
             30          (2) The following distributions are permitted on the House floor:
             31          (a) an informational or educational item distributed by a Representative, stamped with
             32      the Representative's name or accompanied by official letterhead; and
             33          (b) information and documents provided by legislative staff.
             34          Section 2. HR-38.02 is amended to read:
             35           HR-38.02. Lobbyist Code of Ethics.
             36          A lobbyist, volunteer lobbyist, or government official may not:
             37          (1) attempt to influence any legislator, elected or appointed state official, state
             38      employee, or legislative employee by means of deceit or by threat of violence or economic or
             39      political reprisal against any person or property, with intent by doing so to alter or affect the
             40      legislator's, elected or appointed state official's, state employee's, or legislative employee's
             41      decision, vote, opinion, or action concerning any matter that is to be considered or performed
             42      by him or the agency or body of which he is a member;
             43          (2) knowingly provide false information to any legislator, elected or appointed state
             44      official, state employee, or legislative employee as to any material fact pertaining to any
             45      legislation;
             46          (3) knowingly omit, conceal, or falsify in any manner information required by the
             47      lobbyist registration and lobbyist disclosure reports;
             48          (4) participate in committee assignments or leadership races of the House of
             49      Representatives;
             50          (5) cause or influence the introduction of any bill or amendment for the purpose of
             51      afterwards becoming employed to secure its passage or defeat;
             52          (6) misappropriate or misuse legislative office supplies;
             53          (7) use legislative reproduction or facsimile machines without paying for that use;
             54          (8) enter or use a legislator's, elected or appointed state official's, state employee's, or
             55      legislative employee's office, phone, computer, or parking space without explicit permission;
             56          (9) attempt to remove or remove any document from any legislator's or legislative
             57      employee's office, desk, file cabinet, reproduction machine, facsimile machine, or any other
             58      place without explicit permission;


             59          (10) engage in sexually harassing behavior or behavior violative of the Utah
             60      Legislature's sexual harassment policy towards legislators or employees of the Legislature;
             61          (11) offer employment to any legislator or legislative employee that impairs the
             62      legislator's or legislative employee's independence of judgement as to their official duties;
             63          (12) offer employment that would require or induce a legislator or legislative employee
             64      to disclose records classified as private, protected, or controlled;
             65          (13) use or disclose for personal financial gain any records classified as private,
             66      protected, or controlled that were obtained from a legislator or legislative employee or conspire
             67      with any person for that purpose; [or]
             68          (14) induce or seek to induce any legislator or legislative employee into committing a
             69      violation of any provision of this House rule[.]; or
             70          (15) distribute a gift or request that a gift be distributed to any legislator or legislative
             71      employee on the House floor.
