             9      General Description:
             10          This bill modifies requirements regarding notice of a public hearing on a proposed
             11      school district budget and public disclosure of a proposed school district budget.
             12      Highlighted Provisions:
             13          This bill:
             14          .    modifies requirements regarding notice of a public hearing on a proposed school
             15      district budget;
             16          .    requires a local school board to post a proposed budget on the school district's
             17      Internet website 10 days prior to a public hearing on the proposed budget; and
             18          .    makes technical amendments.

             27      Be it enacted by the Legislature of the state of Utah:
             28          Section 1. Section 53A-19-102 is amended to read:
             29           53A-19-102. Local school boards budget procedures.


             30          (1) (a) Prior to June 22 of each year, [each] a local school board shall adopt a budget
             31      and make appropriations for the next fiscal year.
             32          (b) If the tax rate in the proposed budget exceeds the certified tax rate defined in
             33      Section 59-2-924 , the local school board shall comply with Section 59-2-919 in adopting the
             34      budget, except as provided by Section 53A-17a-133 .
             35          (2) (a) Prior to the adoption of a budget [containing a tax rate which does not exceed
             36      the certified tax rate, the], a local school board shall hold a public hearing, as defined in
             37      Section 10-9a-103 , on the proposed budget.
             38          (b) In addition to complying with Title 52, Chapter 4, Open and Public Meetings Act,
             39      in regards to the public hearing described in Subsection (2)(a), [the] at least 10 days prior to
             40      the public hearing, a local school board shall:
             41          [(i) publish the required newspaper notice at least 10 days before the day on which
             42      the hearing is held; and]
             43          (i) publish a notice of the public hearing in a newspaper or combination of newspapers
             44      of general circulation in the school district, except as provided in Section 45-1-101 ;
             45          (ii) publish a notice of the public hearing electronically in accordance with Section
             46      45-1-101 ;
             47          [(ii)] (iii) file a copy of the proposed budget with the local school board's business
             48      administrator for public inspection [at least 10 days prior to the hearing.]; and
             49          (iv) post the proposed budget on the school district's Internet website.
             50          (c) A notice of a public hearing on a school district's proposed budget shall include
             51      information on how the public may access the proposed budget as provided in Subsections
             52      (2)(b)(iii) and (2)(b)(iv).
             53          (3) [The] A local school board shall file a copy of the adopted budget with the state
             54      auditor and the State Board of Education.
