             9      Committee Note:
             10          The Executive Appropriations Committee recommended this bill.
             11      General Description:
             12          This bill amends the State Capitol Preservation Board fee schedule for the current fiscal
             13      year.
             14      Highlighted Provisions:
             15          This bill:
             16          .    establishes rental rates for State Capitol facilities during the 2010 General Session
             17      of the Utah State Legislature.
             18      Monies Appropriated in this Bill:
             19          None
             20      Other Special Clauses:
             21          This bill provides an immediate effective date.

             25      Be it enacted by the Legislature of the state of Utah:
             26          Section 1. Fee schedule.
             27          (1) As used in this section, "an event related to the General Session of the Legislature"


             28      means an event held for the primary purpose of:
             29          (a) discussing public policy germane to the legislative session; or
             30          (b) meeting with a legislator.
             31          (2) Notwithstanding the fees and rates for the State Capitol Preservation Board
             32      contained in Laws of Utah 2009, Chapter 396, Section 2, the following fees and rates for an
             33      event related to the General Session of the Legislature are established under Title 63J, Chapter
             34      1, Budgetary Procedures Act, for fiscal year ending June 30, 2010:
             35          (a) (i) During the hours of 7 a.m. to 5:30 p.m. on a Monday, Tuesday, Wednesday,
             36      Thursday, or Friday that is on a date on or between January 25, 2010 and March 11, 2010, there
             37      is a rental rate of $0 for the following rooms located in:
             38          (A) the State Office Building:
             39          (I) Room B110; and
             40          (II) Room 1112; and
             41          (B) the State Capitol:
             42          (I) Room 130;
             43          (II) Room 170; and
             44          (III) Room 210.
             45          (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
             46      time a person may use a room listed in Subsection (2)(a)(i) at the rental rate established in
             47      Subsection (2)(a)(i).
             48          (B) A person using a room listed in Subsection (2)(a)(i) in excess of the time
             49      established by rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396,
             50      Section 2.
             51          (b) (i) During the hours of 7 a.m. to 11 a.m. and 1:30 p.m. to 5:30 p.m. on a Monday,
             52      Tuesday, Wednesday, Thursday, or Friday that is on a date on or between January 25, 2010 and
             53      March 11, 2010, there is a rental rate of $0 for the following rooms located in the Senate
             54      Building:
             55          (A) Kletting Room;
             56          (B) Olmstead Room;
             57          (C) Spruce Room;
             58          (D) Beehive Room;


             59          (E) Seagull Room; and
             60          (F) Copper Room.
             61          (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
             62      time a person may use a room listed in Subsection (2)(b)(i) at the rental rate established in
             63      Subsection (2)(b)(i).
             64          (B) A person using a room listed in Subsection (2)(b)(i) in excess of the time
             65      established by rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396,
             66      Section 2.
             67          (c) (i) During the hours of 11 a.m. to 1:30 p.m. on a Monday, Tuesday, Wednesday,
             68      Thursday, or Friday that is on a date on or between January 25, 2010 and March 11, 2010, there
             69      is a rental rate of $0 for the following rooms located in the Senate Building if the renter uses a
             70      preferred caterer to provide food services during the room rental or provides evidence that
             71      attendees have purchased food from a preferred caterer:
             72          (A) Kletting Room;
             73          (B) Olmstead Room;
             74          (C) Spruce Room;
             75          (D) Beehive Room;
             76          (E) Seagull Room; and
             77          (F) Copper Room.
             78          (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
             79      time a person may use a room listed in Subsection (2)(c)(i) at the rental rate established in
             80      Subsection (2)(c)(i).
             81          (B) A person using a room listed in Subsection (2)(c)(i) in excess of the time
             82      established by rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396,
             83      Section 2.
             84          (d) (i) (A) During the hours of 7 a.m. to 11 a.m. and 1:30 p.m. to 5:30 p.m. on a
             85      Monday, Tuesday, Wednesday, Thursday, or Friday that is on a date on or between January 25,
             86      2010 and March 11, 2010, the State Office Building Auditorium has the following rental rates:
             87          (I) $50 per hour, if the renter is a non-profit organization; and
             88          (II) $100 per hour, if the renter is a for profit organization.
             89          (B) During the hours of 11 a.m. to 1:30 p.m. on a Monday, Tuesday, Wednesday,


             90      Thursday, or Friday that is on a date on or between January 25, 2010 and March 11, 2010, the
             91      State Office Building Auditorium has the following rental rates:
             92          (I) $0, if the renter:
             93          (Aa) uses a preferred caterer to provide food services during the room rental; or
             94          (Bb) provides evidence that attendees have purchased food from a preferred caterer;
             95          (II) $50 per hour, if the renter:
             96          (Aa) is a non-profit organization; and
             97          (Bb) does not provide evidence that meals served in the auditorium were purchased
             98      from a preferred caterer; and
             99          (III) $100 per hour if the renter:
             100          (Aa) is a for profit organization; and
             101          (Bb) does not provide evidence that meals served in the auditorium were purchased
             102      from a preferred caterer.
             103          (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
             104      time a person may use the auditorium at the rental rate established in Subsection (2)(d)(i).
             105          (B) A person using the State Office Building Auditorium in excess of the time
             106      established by rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396,
             107      Section 2.
             108          (e) (i) On a date on or between January 25, 2010 and March 11, 2010, the State Capitol
             109      Board Room has the following rental rates:
             110          (A) $75 per hour for a non-profit organization; and
             111          (B) $150 per hour for a for profit organizations.
             112          (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
             113      time a person may use the State Capitol Board Room at the rental rates established in
             114      Subsection (2)(e)(i).
             115          (B) A person using the State Capitol Board Room in excess of the time established by
             116      rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396, Section 2.
             117          (f) (i) During the hours of 7 a.m. to 5:30 p.m. on a date on or between January 25, 2010
             118      and March 11, 2010, there is a rental rate of $0 for the following:
             119          (A) the Capitol Rotunda; and
             120          (B) the Hall of Governors.


             121          (ii) (A) The State Capitol Preservation Board may establish the maximum amount of
             122      time a person may use a facility listed in Subsection (2)(f)(i) at the rental rate established in
             123      Subsection (2)(f)(i).
             124          (B) A person using a facility listed in Subsection (2)(f)(i) in excess of the time
             125      established by rule shall pay the rental rate established by Laws of Utah 2009, Chapter 396,
             126      Section 2.
             127          Section 2. Effective date.
             128          If approved by two-thirds of all the members elected to each house, this bill takes effect
             129      upon approval by the governor, or the day following the constitutional time limit of Utah
             130      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
             131      the date of veto override.
