11 LONG TITLE
12 General Description:
13 This bill requires parental notification regarding remediation for certain students that
14 read below grade level.
15 Highlighted Provisions:
16 This bill:
17 . requires a school district or charter school to provide notice to a parent or guardian
18 of a student in the first, second, or third grade:
19 . if the student is reading below grade level; and
20 . of available reading interventions available through the school district or charter
21 school;
22 . requires a school district or charter school to provide appropriate reading
23 remediation;
24 . requires the State Board of Education to make rules; and
25 . requires the State Board of Education to annually report certain information
26 regarding students who read below grade level and interventions provided to those students to
27 the Education Interim Committee.

36 Be it enacted by the Legislature of the state of Utah:
37 Section 1. Section 53A-1-606.6 is enacted to read:
38 53A-1-606.6. Notice for students reading below grade level -- Report to Education
39 Interim Committee -- Rulemaking.
40 (1) (a) A school district or charter school shall:
41 (i) notify a parent or guardian of a first, second, or third grade student, prior to the
42 midpoint of the school year, that the first, second, or third grade student is reading below grade
43 level, as determined by multiple assessments administered pursuant to this part, and pursuant to
44 rules enacted under Subsection (2);
45 (ii) provide information to a parent or guardian of a student described in Subsection
46 (1)(a)(i) regarding reading remediation inteventions available through the school district or
47 charter school; and
48 (iii) provide focused reading remediation through appropriate interventions that may
49 include tutoring, before and after school programs, or summer school assistance.
50 (b) A school district or charter school shall provide the following in the primary
51 language of the parent or guardian of a student described in Subsection (1)(a)(i):
52 (i) a notification described in Subsection (1)(a)(i); and
53 (ii) information provided pursuant to Subsection (1)(a)(ii).
54 (2) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
55 State Board of Education shall make rules defining expected reading levels for first, second,
56 and third grades.
57 (3) On or before the November meeting of the Education Interim Committee of each
58 year, the State Board of Education shall report:
59 (a) the number of students reading below grade level described in Subsection (1)(a)(i)
60 identified during the prior school year; and
61 (b) the number of students described in Subsection (1)(a)(i) who received reading
62 intervention during the prior school year.
63 (4) Nothing in this section shall be interpreted to imply that a student may, or may not
64 be advanced to the next grade level based on the student's reading ability measured in
65 accordance with this section.
