9 LONG TITLE
10 General Description:
11 This concurrent resolution of the Legislature and the Governor gives approval for the
12 change in classification of a landfill from a class IV facility to a class VI facility.
13 Highlighted Provisions:
14 This resolution:
15 . addresses the proposed Central Valley Landfill that is owned by Central Valley
16 Water Reclamation Facility and managed by Construction Waste Management,
17 LLC, and located in the city of Salt Lake in Salt Lake County; and
18 . grants statutorily required approval of the operating plan, as approved by the
19 Department of Environmental Quality, and allows the Central Valley Landfill to
20 change classification from a class IV landfill to a class VI landfill and receive
21 nonhazardous construction and demolition waste and other waste as approved in the
22 operating plan issued by the executive secretary of the Solid and Hazardous Waste
23 Control Board.

27 Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
28 WHEREAS, Central Valley Water Reclamation Facility and Construction Waste
29 Management, LLC desire to change the operation of the Central Valley Landfill from a class IV
30 noncommercial landfill to a class VI commercial landfill to receive nonhazardous solid waste
31 for treatment, storage, or disposal as defined in Subsection 19-6-102 (4) and other wastes
32 described in Subsection 19-6-119 (1)(a)(ii) and allowed under the approved operating plan
33 issued by the executive secretary of the Solid and Hazardous Waste Control Board;
34 WHEREAS, the facility is to be located at the site currently known as the Central
35 Valley Landfill;
36 WHEREAS, this site is a rectangular shaped 76.5-acre parcel in Section 16, Township 1
37 South, Range 2 West, Salt Lake Base and Meridian, and is located approximately nine miles
38 southwest of downtown Salt Lake City, in Salt Lake County;
39 WHEREAS, Central Valley Water Reclamation Facility and Construction Waste
40 Management, LLC currently operate a noncommercial nonhazardous solid waste facility at this
41 site as a class IV landfill that receives waste allowed by the approved operating plan and under
42 contract with local governments;
43 WHEREAS, Section 19-6-108 requires that an applicant for a change in classification
44 from a class IV landfill to a class VI landfill receive approval from the Utah State Legislature
45 and the Governor of the State as a part of the approval process;
46 WHEREAS, Section 19-6-108 also requires that an applicant for authority to change
47 landfill classifications receive approval from the executive secretary of the Solid and
48 Hazardous Waste Control Board within the Department of Environmental Quality prior to
49 receiving legislative and gubernatorial approval;
50 WHEREAS, Central Valley Water Reclamation Facility and Construction Waste
51 Management, LLC have submitted a proposed operation plan for the Central Valley Landfill to
52 change from a class IV landfill to a class VI commercial nonhazardous solid waste landfill to
53 the Department of Environmental Quality, and the operation plan was approved by the
54 executive secretary of the Solid and Hazardous Waste Control Board on January 27, 2010, and
55 this approval was effective on February 1, 2010; and
56 WHEREAS, the approved operating plan for the Central Valley Landfill allows the
57 landfill to receive nonhazardous waste, construction and demolition waste, and other waste as
58 approved in the operating plan issued by the executive secretary of the Solid and Hazardous
59 Waste Control Board:
60 NOW, THEREFORE, BE IT RESOLVED by the Legislature, the Governor concurring
61 therein, that Central Valley Water Reclamation Facility and Construction Waste Management,
62 LLC are granted approval to construct and operate a class VI commercial nonhazardous solid
63 waste landfill known as the Central Valley Landfill in Salt Lake City, Utah.
