Rep. Ray called the meeting to order at 8:38 a.m. and welcomed a group of students from Uintah High School.

MOTION:    Rep. Vickers moved to approve the minutes of the February 16, 2010 meeting. The motion passed unanimously with Rep. Sandstrom absent for the vote.


H.B. 104    Unlawful Provision of Identifiable Prescription Information (Rep. J. Biskupski)

This bill was not considered.


H.B. 311    Autism Treatment Fund (Rep. R. Lockhart)

MOTION:    Rep. Menlove moved to adopt 1st Substitute H.B. 311. The motion passed unanimously with Rep. Sandstrom absent for the vote.

Rep. Lockhart explained the substitute bill to the committee.

MOTION:    Rep. Daw moved to pass the bill with a favorable recommendation. The motion passed unanimously with Rep. Sandstrom absent for the vote.

MOTION:    Rep. Menlove moved to place 1st Substitute H.B. 311 on the Consent Calendar. The motion passed unanimously with Rep. Sandstrom absent for the vote.




S.B. 41S1    Drug Utilization Review Board Amendments (Sen. P. Knudson)


Sen. Knudson explained the bill to the committee, assisted by Tim Morley, Utah Department of Health and member of the Drug Utilization Review Board.

Rep. Ray relinquished the chair to Rep. Menlove.

Spoke in opposition to the bill:    Michael Mason, psychiatrist, Valley Mental Health
                    Richard Montano, Epilepsy Association of Utah

During the discussion Rep. Ray resumed the chair.

MOTION:    Rep. Sandstrom moved to amend the bill as follows:

    House Committee Amendments
    2-18-2010 :
    

             70          (2) H. [(a)] .H The board may, H. [when the board determines it is appropriate]
  only       after

             70a      complying with Subsections (1)(b) through (j) .H , consider the cost:
             71          H. [(i)] (a) .H of a drug when placing a drug on the prior approval program; and
             72          H. [(ii)] (b) .H associated with including, or excluding a drug from the prior approval
             72a      process,
             73      including:
             74          H. [(A)] (i) .H potential side effects associated with a drug; or
             75          H. [(B)] (ii) .H potential hospitalizations or other complications that may occur as a result
             75a      of a
             76      drug's inclusion on the prior approval process.
             77          H. [(b) If the board considers the cost of a drug under Subsection (2)(a), the provisions of

The motion to amend the bill passed unanimously with Rep. Menlove absent for the vote.




MOTION:    Rep. Daw moved to pass 1st Substitute S.B. 41 with a favorable recommendation. The motion passed with Rep. Ray voting in opposition to the motion and Rep. Menlove absent for the vote.


MOTION:    Rep. Riesen moved to adjourn the meeting. The motion passed unanimously with Rep. Menlove absent for the vote.

Rep. Ray adjourned the meeting at 9:38 a.m.
