Rep. Hunsaker called the meeting to order at 8:36 a.m.

MOTION: Rep. Black moved to approve the minutes from the meeting of February 2, 2010. The motion passed unanimously with Rep. Webb absent for the vote.

H.B. 205    Impact Fee Amendments (Rep. S. Sandstrom)

Rep. Sandstrom introduced and explained the bill and its substitute to the committee.

MOTION: Rep. Chavez-Houck moved to adopt 1st Sub HB205. The motion passed unanimously with Rep. Dunnigan and Rep. Webb absent for the vote.

Rep. Sandstrom explained the amendment to the committee.

MOTION: Rep. Draxler moved to adopt the following amendment:

1.    Page 6, Lines 152 through 159 :    

             152          (g)(i)
{   The   }        Subject to Subsection (2)(g)(iii), the       plan shall include a public facility        for which an impact fee may be charged or       required for a school district or charter


             153
     school if the local political subdivision is aware of the planned location of the school district
             154      facility or charter school:
             155          (A) through the planning process; or
             156          (B) after receiving a written request from a school district or charter school that the
             157      public facility be included in the plan.
             158          (ii) If necessary, the plan shall be amended to reflect a public facility described in
             159      Subsection (2)(g)(i).
    
  (iii)(A) In accordance with Subsections 10-9a-305(4) and 17-27a-305(4), a local political subdivision may not require a school district or charter school to participate in the cost of any roadway or sidewalk.

    (B) Notwithstanding Subsection (2)(g)(iii)(A), if a school district or charter school agrees to build a roadway or sidewalk, the roadway or sidewalk shall be included in the plan,  


The motion to amend passed unanimously with Rep. Webb absent for the vote.

MOTION: Rep. Black move that the committee recommend favorably 1st Sub. H.B. 205, as amended with Rep. Dunnigan absent for the vote. The motion passed unanimously.

MOTION: Rep. Fisher moved to adjourn. The motion passed unanimously with Rep. Dunnigan absent for the vote.

Rep. Hunsaker adjourned the meeting at 9:02 a.m.
