Chair Valentine called the meeting to order at 8:35 a.m.

1.     S.B. 161 Real Property Transfer Fee Amendments (M. Madsen)
    
    Sen. Madsen explained the bill and answered questions from the committee.

    Sens. VanTassell and Niederhauser declared Conflicts of Interest.

    John Morris, Attorney, Condominiums and Planned Unit Developments, and Curt R. Webb,     House of Representatives, spoke to the bill.

    Susan Peterson, Attorney, The Canyons Resort Association, spoke in opposition to the bill.

    Cort Ashton, President, Utah Land Title Association, spoke in support of the bill.

     MOTION: Sen. Urquhart moved to proceed to the next item on the agenda.

     SUBSTITUTE MOTION: Sen. Niederhauser moved to amend the bill as follows:         


1.    Page 5, Lines 123 through 127 :    

             123          (B) the federal government or a state or local government entity.
             124          (2) (a) Except as provided in Subsection (3), a transfer fee covenant
{  , whether   } recorded

             125     
{  before,   } on      {  ,   } or after May 11, 2010      {  ,   } is:

             126          (i) against public policy; and
             127          (ii) void and unenforceable.
    
    The motion passed unanimously.

     MOTION: Sen. Niederhauser moved to transmit S,B, 161 as amended with a favorable     recommendation.

     SUBSTITUTE MOTION: Sen. Urquhart moved to proceed to the next item on the agenda.

    The motion passed with Sens. Liljenquist, Urquhart, VanTassell, Davis and Mayne voting in     favor and Sens. Valentine and Niederhauser voting in opposition.

2.    S.B. 231 Medical Benefits Under Workers' Compensation
(D.C. Buttars)

    Sen. Buttars explained the bill.

    Eileen Miller, citizen, spoke in favor of the bill.

     MOTION: Sen. Niederhauser moved to adjourn.

    The motion passed unanimously.

    Chair Valentine adjourned the meeting at 10:15 a.m.
