Chair Stowell called the meeting to order at 8:03 a.m.

1.     Welcome and Approval of Minutes

    Committee Chair Stowell welcomed the committee and visitors .

         MOTION: Sen. Christensen moved to approve the minutes of February 26, 2010.



        The motion passed unanimously.

2.    H.J.R. 21 Joint Resolution on Energy Policy (M. Noel)
    
    Rep. Noel introduced the resolution.    

    Joseph Andrade, Professor of Bioengineering at the University of Utah, spoke against the resolution.
    
    Stan Rasmussen, Public Affairs Manager of the Sutherland Institute, spoke in favor of the resolution.

    Mike Peterson, representing Utah Rural Electric, spoke in favor of the resolution.

    Gem Morris, citizen, spoke in favor of the resolution.

         MOTION: Sen. Davis made a motion to move the agenda.

        The motion failed with Sen. Davis voting yes and Sen. Dayton and Sen. Morgan absent from the vote.

         MOTION: Sen. Okerlund moved to pass HJR 21 out of committee with a favorable recommendation.

        The motion passed with Sen. Davis voting in opposition and Sen. Dayton and Sen. Morgan absent from the vote.
    
3.    H.B. 298 S01 Land Use Authority Notification of Canal Development (B. Ferry)

    Rep. Ferry introduced the bill.

         MOTION: Sen. Stowell moved to amend HB 298 as follows:

1.    Page 3, Line 76 :    

             76      land
  , subject to Subsection (1)(b)(iv)(C),       located within 100 feet of the center line of a canal, the land use authority shall:

             85      10-9a-211 .
    
  (C) The location of land described in Subsection (1)(b)(iv)(A) shall be:

        (I) provided by a canal company or canal operator to the land use authority; and
        (II) (Aa) determined by use of mapping-grade global positioning satellite units; or
            (Bb) digitized from the most recent areal photo available to the canal company or canal operator.

    Adam Trupp, General Counsel with the Utah Association of Counties, spoke to the bill.

    Bill Rigby, Supervisor with the Utah Association of Conservation Districts, spoke in favor of the bill.

    Sterling Brown, V.P. of Public Policy with the Utah Farm Bureau, spoke in favor of the bill.
    
    
Keith Denos, General Manager of Provo River Water Users, spoke to the bill.

    Terel Grimley, President of North Ogden Water Company, spoke to the bill.

         MOTION: Sen. Christensen moved to table H.B. 298 1st Substitute.


        The motion failed with Sen. Dayton and Sen. Morgan absent from the vote.

         MOTION: Sen. Christensen moved to pass H.B. 298 1st Substitute out of committee with a favorable recommendation.

        
The motion passed unanimously with Sen. Dayton and Sen. Morgan absent from the vote.

4.    H.B. 60 S01 Water Conveyance Facilities Safety Act (F. Hunsaker)

    Rep. Hunsaker introduced the bill.

         MOTION: Sen. Christensen moved to pass H.B. 60 out of committee with a favorable recommendation.

        The motion passed unanimously with Sen. Dayton and Sen Morgan absent from the vote.

: Sen. Christensen moved to adjourn.

The motion passed unanimously with Sen. Dayton and Sen. Morgan absent for the vote.

Chair Stowell adjourned the meeting at 9:04 a.m.
