             9      General Description:
             10          This bill amends the State Capitol Preservation Board fee schedule for the current fiscal
             11      year.
             12      Highlighted Provisions:
             13          This bill:
             14          .    establishes rental rates for State Capitol facilities during the 2011 General Session
             15      of the Utah State Legislature.
             16      Money Appropriated in this Bill:
             17          None
             18      Other Special Clauses:
             19          This bill provides an immediate effective date.

             23      Be it enacted by the Legislature of the state of Utah:
             24          Section 1. Fee schedule.
             25          (1) As used in this section, "an event related to the general session of the Legislature"
             26      means an event held for the primary purpose of:
             27          (a) discussing public policy germane to the legislative session; or
             28          (b) meeting with a legislator.
             29          (2) Notwithstanding the fees and rates for the State Capitol Preservation Board


             30      contained in Laws of Utah 2010, Chapter 408, Section 3, the fees and rates contained in this
             31      section for an event related to the general session of the Legislature are established under Title
             32      63J, Chapter 1, Budgetary Procedures Act, for fiscal year ending June 30, 2011.
             33          (3) During the hours of 7 a.m. to 5:30 p.m. on a Monday, Tuesday, Wednesday,
             34      Thursday, or Friday that is on a date on or between January 24, 2011, and March 10, 2011, the
             35      rental rate is $0 for:
             36          (a) Room 8110 or Room 1112 in the State Office Building; or
             37          (b) Room 130, Room 170, or Room 210 in the State Capitol.
             38          (4) During the hours of 7 a.m. to 11 a.m. and 1:30 p.m. to 5:30 p.m. on a Monday,
             39      Tuesday, Wednesday, Thursday, or Friday that is on a date on or between January 24, 2011,
             40      and March 10, 2011, the rental rate is $0 for the following rooms located in the Senate
             41      Building:
             42          (a) Kletting Room;
             43          (b) Olmstead Room;
             44          (c) Spruce Room;
             45          (d) Beehive Room;
             46          (e) Seagull Room; and
             47          (f) Copper Room.
             48          (5) During the hours of 11 a.m. to 1:30 p.m. on a Monday, Tuesday, Wednesday,
             49      Thursday, or Friday that is on a date on or between January 24, 2011, and March 10, 2011, the
             50      rental rate is $0 for the following rooms located in the Senate Building if the renter uses a
             51      preferred caterer to provide food services during the room rental or provides evidence that
             52      attendees have purchased food from a preferred caterer:
             53          (a) Kletting Room;
             54          (b) Olmstead Room;
             55          (c) Spruce Room;
             56          (d) Beehive Room;
             57          (e) Seagull Room; and


             58          (f) Copper Room.
             59          (6) (a) During the hours of 7 a.m. to 11 a.m. and 1:30 p.m. to 5:30 p.m. on a Monday,
             60      Tuesday, Wednesday, Thursday, or Friday that is on a date on or between January 24, 2011,
             61      and March 10, 2011, the State Office Building Auditorium has the following rental rates:
             62          (i) $50 per hour, if the renter is a non-profit organization; and
             63          (ii) $100 per hour, if the renter is a for profit organization.
             64          (b) During the hours of 11 a.m. to 1:30 p.m. on a Monday, Tuesday, Wednesday,
             65      Thursday, or Friday that is on a date on or between January 24, 2011, and March 10, 2011, the
             66      State Office Building Auditorium has the following rental rates:
             67          (i) $0, if the renter:
             68          (A) uses a preferred caterer to provide food services during the room rental; or
             69          (B) provides evidence that attendees have purchased food from a preferred caterer;
             70          (ii) $50 per hour, if the renter:
             71          (A) is a non-profit organization; and
             72          (B) does not provide evidence that meals served in the auditorium were purchased
             73      from a preferred caterer; and
             74          (iii) $100 per hour if the renter:
             75          (A) is a for profit organization; and
             76          (B) does not provide evidence that meals served in the auditorium were purchased
             77      from a preferred caterer.
             78          (7) On a date on or between January 24, 2011, and March 10, 2011, the State Capitol
             79      Board Room has the following rental rates:
             80          (a) $75 per hour for a non-profit organization; and
             81          (b) $150 per hour for a for profit organization.
             82          (8) During the hours of 7 a.m. to 5:30 p.m. on a date on or between January 24, 2011,
             83      and March 10, 2011, there is a rental rate of $0 for the following:
             84          (a) the Capitol Rotunda; and
             85          (b) the Hall of Governors.


             86          (9) (a) The State Capitol Preservation Board may establish the maximum amount of
             87      time a person may use a facility listed in this section at the rental rate established in this
             88      section.
             89          (b) A person using a facility listed in this section in excess of the time established by
             90      rule shall pay the rental rate established by Laws of Utah 2010, Chapter 408, Section 3.
             91          Section 2. Effective date.
             92          If approved by two-thirds of all the members elected to each house, this bill takes effect
             93      upon approval by the governor, or the day following the constitutional time limit of Utah
             94      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
             95      the date of veto override.
