             9      General Description:
             10          This resolution of the Legislature modifies joint rules.
             11      Highlighted Provisions:
             12          This resolution:
             13          .    changes the makeup of the membership of the Executive Appropriations Committee
             14      to provide that membership of the committee shall consist of the chair and vice
             15      chair of the Senate and House appropriations committees and eight other members
             16      from each house;
             17          .    provides that the remaining eight members from each house be approximately
             18      proportionate to the majority and minority makeup of the membership of each house
             19      and be appointed by the President and Speaker or minority leaders, respectively;
             20          .    provides that a rounding error shall be resolved in favor of the minority party; and
             21          .    makes technical changes.

             28      Be it resolved by the Legislature of the state of Utah:
             29          Section 1. JR3-2-401 is amended to read:
             30           JR3-2-401. Executive Appropriations -- Creation -- Membership -- Quorum and
             31      Voting Requirements.
             32          (1) There is created an Executive Appropriations Committee consisting of [20
             33      members] 10 members from the Senate and 10 members from the House composed [of] as
             34      follows:
             35          [(a) three members of the majority leadership of the Senate and four members of the
             36      majority leadership of the House;]
             37          [(b) two members of the minority leadership of the Senate and three members of the
             38      minority leadership of the House;]
             39          [(c) the chair and vice chair of the Senate Appropriations Committee and the chair and
             40      vice chair of the House Appropriations Committee; and]
             41          [(d) (i) one member from the majority party of the Senate as appointed by the President
             42      of the Senate or as chosen by the Senate majority caucus;]
             43          [(ii) two members from the minority party of the Senate as appointed by the Senate
             44      minority leader or as chosen by the Senate minority caucus; and]
             45          [(iii) one member from the minority party of the House as appointed by the House
             46      minority leader or as chosen by the House minority caucus.]
             47          [(2) A member of the Executive Appropriations Committee, whose membership is
             48      determined under Subsection (1)(a) or (b), may appoint a designee to permanently serve in that
             49      individual's place if:]
             50          [(a) the person is a member of the majority party and the designee is approved by the
             51      Speaker or the President; or]
             52          [(b) the person is a member of the minority party and the designee is approved by the
             53      House or Senate minority party leader.]
             54          (a) the chair and vice chair of the Senate Appropriations Committee;
             55          (b) the chair and vice chair of the House Appropriations Committee; and
             56          (c) the other eight remaining members from each house shall be appointed from each
             57      party so that the member from each party is approximately proportionate to the political party
             58      makeup of the membership of each house and shall be appointed as follows:


             59          (i) the members from the majority party of the Senate shall be appointed by the
             60      President of the Senate;
             61          (ii) the members from the minority party of the Senate shall be appointed by the Senate
             62      minority leader;
             63          (iii) the members from the majority party of the House shall be appointed by the
             64      Speaker of the House; and
             65          (iv) the members from the minority party of the House shall be appointed by the House
             66      minority leader.
             67          (2) If the allocation of members from a house under Subsection (1)(c) does not evenly
             68      match the proportionate makeup of the membership of the house, the rounding margin shall
             69      favor the minority party.
             70          (3) (a) A majority of the Executive Appropriations Committee is a quorum for the
             71      transaction of business.
             72          (b) In determining a committee quorum, a majority is at least 50% in one house and
             73      more than 50% in the other.
             74          (4) (a) In all decisions of the Executive Appropriations Committee, a majority vote
             75      prevails.
             76          (b) A majority vote is at least 50% of the members of one house and more than 50% of
             77      the members of the other house in attendance.
             78          (5) The Office of Legislative Fiscal Analyst shall staff the Executive Appropriations
             79      Committee and its subcommittees.
