7 LONG TITLE
8 General Description:
9 This bill creates the Governor's Economic Development Coordinating Council to plan,
10 coordinate, and recommend strategies, goals, and activities related to economic growth
11 and development in the state.
12 Highlighted Provisions:
13 This bill:
14 . creates the Governor's Economic Development Coordinating Council and provides
15 for its membership; and
16 . provides that council's duties and powers shall include:
17 . coordinating and advising on policies and objectives related to economic
18 development and growth in the state;
19 . coordinating to avoid duplication and increase the availability of venture and
20 seed capital for research and development and growth of new and existing
21 businesses;
22 . focusing on technologies, industries, and geographical areas in which the state
23 can expand investment and stimulate job growth; and
24 . coordinating ideas and strategies to increase national and international business
25 activities for both urban and rural areas of the state.

37 Be it enacted by the Legislature of the state of Utah:
38 Section 1. Section 63M-1-1301 is enacted to read:

40 63M-1-1301. Title.
41 This part is known as the "Governor's Economic Development Coordinating Council."
42 Section 2. Section 63M-1-1302 is enacted to read:
43 63M-1-1302. Purpose.
44 This part is enacted to create the Governor's Economic Development Coordinating
45 Council for the purpose of:
46 (1) planning, coordinating, and recommending economic development strategies,
47 goals, and activities for industries, businesses, and other public and private sector entities and
48 economic development stakeholders; and
49 (2) coordinating activities that enhance investment in Utah businesses from the private
50 sector to maximize the availability of venture and seed capital for research and business growth
51 and development in the state.
52 Section 3. Section 63M-1-1303 is enacted to read:
53 63M-1-1303. Creation of council -- Membership.
54 (1) There is created the Governor's Economic Development Coordinating Council,
55 hereafter referred to in this part as the "council", consisting of the following 11 members:
56 (a) the director, who shall serve as chair of the council;
57 (b) the chair of the board or the chair's designee;
58 (c) the chair of the Utah Science Technology and Research Governing Authority or the
59 chair's designee;
60 (d) the chair of the Utah Rural Development Council or the chair's designee;
61 (e) the chair of the Utah Capital Investment Corporation or the chair's designee;
62 (f) the chair of the Economic Development Corporation of Utah or its successor
63 organization or the chair's designee;
64 (g) the chair of the World Trade Center Utah or its successor organization or the chair's
65 designee; and
66 (h) four members appointed by the governor, with the advice and consent of the
67 Senate, who have expertise in the area of business or economic development, entrepreneurship,
68 or the raising of venture or seed capital for research and business growth.
69 (2) (a) The four members appointed by the governor may serve for no more than two
70 consecutive two-year terms.
71 (b) The governor shall appoint a replacement if a vacancy occurs from the membership
72 described under Subsection (1)(h).
73 (3) Six members of the council constitute a quorum for the purpose of conducting
74 council business and the action of a majority of a quorum constitutes the action of the council.
75 (4) A member may not receive compensation or benefits for the member's service on
76 the council, but may receive per diem and travel expenses in accordance with:
77 (a) Sections 63A-3-106 and 63A-3-107 ; and
78 (b) rules made by the Division of Finance pursuant to Sections 63A-3-106 and
79 63A-3-107 .
80 (5) The office shall provide office space and administrative staff support for the
81 council.
82 (6) The council, as a governmental entity, has all the rights, privileges, and immunities
83 of a governmental entity of the state and its meetings are subject to Title 52, Chapter 4, Open
84 and Public Meetings Act.
85 Section 4. Section 63M-1-1304 is enacted to read:
86 63M-1-1304. Council powers and duties.
87 (1) The council shall:
88 (a) coordinate and advise on policies and objectives related to economic development
89 and growth within the state;
90 (b) coordinate with state and private entities, including private venture capital and seed
91 capital firms, to avoid duplication of programs and to increase the availability of venture and
92 seed capital for research and for the development and growth of new and existing businesses in
93 the state;
94 (c) focus on technologies, industries, and geographical areas of the state in which the
95 state can expand investment and entrepreneurship and stimulate job growth;
96 (d) coordinate ideas and strategies to increase national and international business
97 activities for both the urban and rural areas of the state; and
98 (e) plan, coordinate, advise, or recommend any other action that would better the state's
99 economy.
100 (2) The council shall prepare and present an annual report of its activities to the
101 governor and to the Legislature's Workforce Services and Community and Economic
102 Development Interim Committee.
