Rep. Painter called the meeting to order at 4:04 p.m.

MOTION:    Rep. Dougall moved to approve the minutes of the January 24, 2011 meeting with a correction that Rep. Dougall's absence was excused. The motion passed unanimously with Rep. Cosgrove, Rep. Fisher, Rep. Hutchings, and Rep. Newbold absent for the vote.

H.J.R. 1    Joint Resolution Amending State and Local Taxing Authority (Rep. C. Wimmer)

MOTION:    Rep. Wimmer moved to amend the resolution as follows:

1.    Page 1, Line 16 :    

             16      providing a service
{   .   }        ; and

    . provide an exception for local legislative and governing bodies with five or fewer members.  


2.    Page 2, Line 48 :    

             48          
  (1)       The approval of two-thirds of the legislative body or governing body, as applicable, is



3.    Page 2, Lines 51 through 52 :    

             51          
{   (1)   }        (a)       a tax increase; or

             52          
{   (2)   }        (b)       a fee increase if the increased fee will generate revenue exceeding the actual cost of


4.    Page 2, Line 53 :    

             53      providing the service for which the fee is charged.
    
  (2) Subsection (1) does not apply to a legislative or governing body with five or fewer members.      


The motion to amend passed unanimously, with Rep. Cosgrove, Rep. Fisher, Rep. Harper, Rep. Hutchings, and Rep. Newbold absent for the vote.        

Rep. Wimmer explained the bill to the committee and provided a power point presentation.

MOTION:    Rep. Brown called for previous question. The motion passed with Rep. Dougall voting in opposition.

MOTION:    Rep. Butterfield moved to pass the bill with a favorable recommendation. The motion failed with Rep. Butterfield, Rep. Dougall, Rep. Hutchings, Rep. Newbold, Rep. Nielson, Rep. Wimmer, and Rep. Painter voting in favor. Voting in opposition to the motion were Rep. Briscoe, Rep. Brown, Rep. Clark, Rep. Cosgrove, Rep. Duckworth, Rep. Fisher, and Rep. King. Rep. Froerer was absent for the vote.

MOTION:    Rep. Clark moved to adjourn. The motion passed unanimously with Rep. Froerer absent for the vote. Rep. Painter adjourned the meeting at 5:40 p.m.
