Rep. Daw called the meeting to order at 8:06 a.m.

MOTION:    Rep. Kiser moved to approve the minutes of the February 24, 2011 meeting. The motion passed unanimously with Rep. Harper, Rep. Last, Rep. Nielson, and Rep. Sumsion absent for the vote.

S.B. 45    Wireless Telephone Use Restriction for Minors in Vehicles (Sen. R. Romero) (Rep. L. Perry)

This bill was not considered.

H.B. 296    Highway Construction Contract Amendments (Rep. C. Oda)

Rep. Oda introduced the bill to the committee.

MOTION:    Rep. Julie Fisher moved to amend the bill as follows:

1.    Page 1, Line 26 through Page 2, Line 30 :    

             26          72-6-108.5. Class B and C roads -- Federal-aid highway construction contract.


             27          
  (1)       Subject to the requirements of 23 C.F.R. 1.3 and if requested by a local highway

             28      authority that is the sponsor of the federal-aid highway construction project, the department
             29      shall allow a local highway authority to be an additional contracting party for a federal-aid
             30      highway construction contract on a class B or C road along with the department.
      (2) If a local highway authority makes a request to be an additional contracting party under Subsection (1), the department may include the local highway authority as an additional bondholder or obligee on the performance bond.

    (3) Notwithstanding the provisions of this section, the department shall have the final authority to make decisions relating to a federal-aid highway construction contract on a class B or C road.
