Chair H. Stephenson called the meeting to order at 4:07 P.M.

MOTION: Sen. Morgan moved to approve the minutes of the January 26, 2011 meeting.

The motion passed unanimously with Sens. Niederhauser and Thatcher absent for the vote.
    
1.         S.B. 46 - Higher Education Residency Requirements

        Sen. Dayton introduced and explained the bill.

        Mr. Liechty, Mr. Buhler, and Mr. Schanti spoke in favor of the bill.




         MOTION: Sen. Hillyard moved to adopt the following amendment:

1.    Page 4, Line 90 :    

             90          (C) the military parent's Utah voter registration card
  dated a reasonable period prior to application       ;


2.    Page 4, Lines 93 through 94 :    

             93          (E) a current Utah vehicle registration document with the military parent's name as
             94      owner of the vehicle
  dated a reasonable period prior to application       ; or


        The motion passed with Sens. Hillyard, Niederhauser, J. Stevenson, Thatcher, and Morgan voting in favor, and Sen. H. Stephenson voting in opposition.

         MOTION: Sen. Hillyard moved to make the following amendment:

1.    Page 1, Lines 12 through 13 :    

             12          .    requires an institution of higher education to grant
  undergraduate       resident student status to the

             13      children of certain military personnel if the student produces certain information;

2.    Page 3, Lines 78 through 80 :    

             78          (c) Notwithstanding Subsection (3), an institution within the state system of higher
             79      education shall grant
  undergraduate       resident student status for tuition purposes to a child of a United States

             80      military person assigned to active duty if the child produces:
        
        The motion failed with Sens. Thatcher and Hillyard voting in favor, and Sens. Morgan, Niederhauser, H. Stephenson, and J. Stevenson voting in opposition.

         MOTION: Sen. J. Stevenson moved to pass S.B. 46 out of committee with a favorable recommendation.

        The motion passed unanimously.

2.    S.B. 115 - School Performance Reporting

    Sen. H. Stephenson introduced and explained the bill.


    Dr. Shumway spoke to the bill.

     MOTION: Sen. Morgan moved to pass S.B. 115 out of committee with a favorable recommendation.

    The motion passed unanimously.

3.    S.B. 119 - School District Superintendents Amendments

    Sen. H. Stephenson introduced and explained the bill.
    
    Dr. Shumway and Ms. Gallagher-Fishbaugh spoke to the bill.

    Mr. White and Mr. Cannon spoke in favor of the bill.

     MOTION: Sen. Thatcher moved to pass S.B. 119 out of committee with a favorable recommendation.

    The motion passed unanimously with Sen. Hillyard absent for the vote.

MOTION: Sen. Thatcher moved to adjourn.

The motion passed unanimously with Sen. Hillyard absent for the vote.

Chair Stephenson adjourned the meeting at 5:38 P.M.
