             8      General Description:
             9          This bill amends the General Government Title.
             10      Highlighted Provisions:
             11          This bill:
             12          .    enacts the "State Issued Identification Number Act";
             13          .    defines terms;
             14          .    exempts the State Tax Commission; and
             15          .    requires a government entity to phase out the use of a nine digit number as an
             16      identifying number for an individual if:
             17              .    the government entity can phase out the use of the number under existing
             18      appropriations; or
             19              .    the government entity is redesigning its information technology system and can
             20      phase out the nine digit number.

             31      Be it enacted by the Legislature of the state of Utah:
             32          Section 1. Section 63G-15-101 is enacted to read:

CHAPTER 15. STATE ISSUED IDENTIFICATION NUMBER ACT

Part 1. General Provisions

             35          63G-15-101. Title.
             36          This chapter is known as the "State Issued Identification Number Act."
             37          Section 2. Section 63G-15-102 is enacted to read:
             38          63G-15-102. Definitions.
             39          As used in this chapter:
             40          (1) "Government entity" means the state and its political subdivisions as both are
             41      defined in this section.
             42          (2) "Political subdivision" is as defined in Section 63G-7-102 .
             43          (3) "State":
             44          (a) means the state of Utah;
             45          (b) except as provided in Subsection (3)(c), includes each office, department, division,
             46      agency, authority, commission, board, institution, hospital, college, university, or other
             47      instrumentality of the state; and
             48          (c) does not include the State Tax Commission.
             49          Section 3. Section 63G-15-201 is enacted to read:

             51          63G-15-201. Restrictions for state issued identification numbers.
             52          (1) In accordance with Subsection (2), a government entity may not use a nine digit
             53      number as a person's identification number with the government entity.
             54          (2) The provisions of Subsection (1) apply to the government entity if the government
             55      entity's information technology system is:
             56          (a) capable, within existing appropriations, of creating and using an identification
             57      number that is not a nine digit number; or


             58          (b) undergoing significant reprogramming or design change and the elimination of a
             59      nine digit identification number can be accomplished as part of the reprogramming or redesign,
             60      or the nine digit number that will be used by the government entity:
             61          (i) is a combination of letters and numbers;
             62          (ii) is the individual's Social Security number and the use of the Social Security number
             63      is necessary for the governmental entity; or
             64          (iii) is not the individual's Social Security number, but the government entity can take
             65      steps to ensure that the nine digit number is not an active Social Security number that is
             66      assigned to another person.
