8 General Description:
9 This bill imposes requirements on a school district regarding the use of bond proceeds.
10 Highlighted Provisions:
11 This bill:
12 . requires a school district to use a portion of the proceeds of a general obligation
13 bond issued after May 8, 2012, to conduct or update a seismic safety evaluation of a
14 school district building constructed before 1975; and
15 . provides that a school district is not required to conduct or update a seismic safety
16 evaluation of a building constructed before 1975 if the school district performed a
17 seismic safety evaluation on the building within 25 years of May 8, 2012.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 53A-18-107 is enacted to read:
28 53A-18-107. Requirement to use bond proceeds for seismic safety evaluations.
29 (1) If a school district issues a general obligation bond pursuant to Title 11, Chapter 14,

30 Local Government Bonding, after May 8, 2012, the school district shall use a portion of the
31 bond proceeds to:
32 (a) except as provided in Subsection (3), conduct or update a seismic safety evaluation
33 of each school district building:
34 (i) constructed before 1975; and
35 (ii) used by the school district as a school; and
36 (b) provide a copy of a seismic safety evaluation prepared under Subsection (1)(a) to
37 the Utah Seismic Safety Commission created in Section 63C-6-101 .
38 (2) A seismic safety evaluation conducted under Subsection (1) shall be conducted by a
39 licensed structural engineer familiar with seismic codes.
40 (3) A school district is not required to conduct or update a seismic safety evaluation of
41 a building as required in Subsection (1)(a) if the school district performed a seismic safety
42 evaluation or study on the building within 25 years of May 8, 2012.
