             8      General Description:
             9          This bill provides for the establishment of a pilot online school survey system in which
             10      students, parents, and teachers evaluate schools.
             11      Highlighted Provisions:
             12          This bill:
             13          .    requires the State Board of Education to establish a pilot online school survey
             14      system that includes surveys for:
             15              .    students to evaluate their teachers and school administrators;
             16              .    parents to evaluate their children's teachers, children's schools, and themselves;
             17      and
             18              .    teachers to evaluate their schools and school administrators;
             19          .    requires the State Board of Education to contract with a provider or develop a
             20      system to provide technology for the pilot online school survey system;
             21          .    requires a participating school district or charter school to:
             22              .    administer online student surveys of teachers;
             23              .    make available to parents online access to surveys which they may complete for
             24      their children's teachers and schools; and
             25              .    make available to teachers online access to a survey of their school which they
             26      may complete;
             27          .    directs the State Board of Education to make rules establishing procedures for
             28      administering surveys or making available online access to surveys;
             29          .    requires the State Board of Education to analyze and aggregate the survey data and


             30      publish aggregated survey data on its website; and
             31          .    provides that survey results shall be made available to school districts and school
             32      administrators for the purpose of:
             33              .    determining how to better meet the needs of students and parents;
             34              .    monitoring school improvement efforts; and
             35              .    obtaining data that may be used as part of an educator evaluation system and to
             36      inform decisions on employment and professional development.
             37      Money Appropriated in this Bill:
             38          This bill appropriates:
             39          .    to the State Board of Education - Utah State Office of Education - Initiative
             40      Programs, as a one-time appropriation for fiscal year 2012-13:
             41              .    from the Education Fund, $40,000.
             42      Other Special Clauses:
             43          This bill provides an effective date.

             50      Be it enacted by the Legislature of the state of Utah:
             51          Section 1. Section 53A-1-410 is enacted to read:
             52          53A-1-410. Pilot online school survey system.
             53          (1) As used in this section, "board" means the State Board of Education.
             54          (2) (a) Beginning with the 2012-13 school year, the State Board of Education shall
             55      establish a three-year pilot online school survey system in consultation with representatives of
             56      local school boards, charter school governing boards, school district and school administrators,
             57      teachers, and parents.


             58          (b) The board shall develop the technology, or contract with a provider selected
             59      through a request for proposals process to provide the technology, for the pilot online school
             60      survey system to be used by the board, a school district, or a school.
             61          (3) The purposes of the pilot online school survey system are to:
             62          (a) provide information to school districts and schools on how to better serve and meet
             63      the needs of students and parents;
             64          (b) allow school districts and schools to monitor progress of school improvement
             65      efforts; and
             66          (c) provide data that may be used as part of a school district's or school's educator
             67      evaluation system and inform decisions about employment and professional development.
             68          (4) The pilot online school survey system shall include:
             69          (a) age appropriate surveys for students to evaluate each of their teachers;
             70          (b) age appropriate surveys for students to evaluate their school's administrators;
             71          (c) a survey for parents to evaluate their children's teachers;
             72          (d) a survey for parents to evaluate their children's schools and administrators,
             73      including whether the school or administrators solicited parent involvement in the school;
             74          (e) a survey for parents to self-evaluate their participation in their children's education,
             75      including attendance at parent teacher conferences, involvement in the school, and involvement
             76      in their children's homework;
             77          (f) a survey for teachers to evaluate their school, including safety and security of the
             78      school;
             79          (g) a survey for teachers to evaluate their school's administrators and, if applicable,
             80      their school district's administrators;
             81          (h) statistically valid and reliable measurement tools; and
             82          (i) survey questions that represent information that a student, parent, or teacher has
             83      direct knowledge of.
             84          (5) (a) Except as provided in Subsection (5)(b), the pilot online school survey
             85      instruments shall be uniform statewide to allow for comparison of:


             86          (i) survey results statewide; and
             87          (ii) survey results from year to year.
             88          (b) The State Board of Education may allow a school participating in the pilot program
             89      to create a supplement to the pilot online school survey instrument that includes items specific
             90      to the school.
             91          (6) (a) The board shall select a sampling of schools to participate in and administer the
             92      pilot online school survey to students, parents, and teachers.
             93          (b) The sampling of urban and rural schools selected by the board shall:
             94          (i) represent at least 5% of total state enrollment in public schools; and
             95          (ii) include at least:
             96          (A) eight elementary schools;
             97          (B) eight junior high or middle schools;
             98          (C) eight high schools; and
             99          (D) five charter schools.
             100          (c) The schools selected in Subsection (6)(b)(ii) shall be selected from at least five
             101      school districts.
             102          (d) Except as provided in Subsection (6)(e), a participating school shall survey all of
             103      the students enrolled in the participating school.
             104          (e) A participating school shall survey:
             105          (i) students in grades 1 and 2 if considered appropriate;
             106          (ii) students in grades 3 through 12; and
             107          (iii) parents and teachers of students in kindergarten through grade 12.
             108          (7) (a) A participating school shall, annually for an elementary school or semi-annually
             109      for a secondary school:
             110          (i) administer online student surveys of teachers for each of a student's teachers;
             111          (ii) make available to parents online access to surveys, which they may complete for
             112      each their children's teachers and schools; and
             113          (iii) make available to teachers online access to a survey of their school, which they


             114      may complete.
             115          (b) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
             116      State Board of Education shall make rules establishing procedures for administering or making
             117      available online the surveys specified in Subsection (7)(a), including rules to ensure the privacy
             118      and protection of individual educator survey results.
             119          (8) The survey data shall be available to:
             120          (a) the State Board of Education for the purpose of analyzing and aggregating the
             121      survey data; and
             122          (b) school district and school administrators for the purposes stated in Subsection (2).
             123          (9) On or before the November meeting of the Education Interim Committee in 2012,
             124      the State Board of Education shall report:
             125          (a) the names of the participating schools;
             126          (b) the identity of the provider selected through the request for proposals process; and
             127          (c) the progress of the pilot online school survey system.
             128          (10) On or before the November meeting of the Education Interim Committee in 2013
             129      and 2014, the State Board of Education shall report:
             130          (a) the response rate of students, parents, and teachers in each of the participating
             131      schools; and
             132          (b) the reliability of the pilot online school survey system as an evaluation tool.
             133          Section 2. Section 63I-2-253 is amended to read:
             134           63I-2-253. Repeal dates -- Titles 53, 53A, and 53B.
             135          (1) Section 53A-1-403.5 is repealed July 1, 2012.
             136          (2) Section 53A-1-410 is repealed July 1, 2016.
             137          [(2)] (3) Subsection 53A-1-603 (5) is repealed July 1, 2015.
             138          [(3)] (4) Title 53A, Chapter 1a, Part 10, UPSTART, is repealed July 1, 2014.
             139          [(4)] (5) Subsection 53A-13-110 (4) is repealed July 1, 2013.
             140          [(5)] (6) Section 53A-15-1215 is repealed July 1, 2012.
             141          Section 3. Appropriation.


             142          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the
             143      following sums of money are appropriated from resources not otherwise appropriated out of the
             144      funds or accounts indicated for the fiscal year beginning July 1, 2012, and ending June 30,
             145      2013. These are additions to any amounts previously appropriated for fiscal year 2013.

             150          The Legislature intends that at least $30,000 of the appropriation for Contracts and
             151      Grants be used for technology related to the pilot online school survey system created in
             152      Section 53A-1-410.
             153          Section 4. Effective date.
             154          (1) Except as provided in Subsection (2), this bill takes effect on May 8, 2012.
             155          (2) Uncodified Section 3, Appropriation, takes effect on July 1, 2012.
