             10      LONG TITLE
             11      General Description:
             12          This bill modifies provisions relating to the Utah Schools for the Deaf and the Blind.
             13      Highlighted Provisions:
             14          This bill:
             15          .    requires the State Board of Education to:
             16              .    make rules regarding the qualifications, terms of employment, and duties for the
             17      superintendent of the Utah Schools for the Deaf and the Blind;
             18              .    make rules regarding the operation of the Advisory Council for the Utah
             19      Schools for the Deaf and the Blind; and
             20              .    report verbally and in written form annually to the Education Interim Committee
             21      on the Utah Schools for the Deaf and the Blind;
             22          .    deletes provisions regarding the superintendent and the Advisory Council for the
             23      Utah Schools for the Deaf and the Blind; and
             24          .    makes technical changes.

             37      Be it enacted by the Legislature of the state of Utah:
             38          Section 1. Section 53A-25b-201 is amended to read:
             39           53A-25b-201. Authority of the State Board of Education -- Rulemaking --
             40      Superintendent -- Advisory Council.
             41          (1) The State Board of Education is the governing board of the Utah Schools for the
             42      Deaf and the Blind.
             43          (2) (a) The board shall appoint a superintendent for the Utah Schools for the Deaf and
             44      the Blind.
             45          [(b) (i) Except as provided in Subsection (2)(b)(ii), the superintendent shall:]
             46          [(A) hold an administrative/supervisory license;]
             47          [(B) have demonstrated success in administration of education programs;]
             48          [(C) have demonstrated skill in organizational management; and]
             49          [(D) have a knowledge of special education practice and law.]
             50          [(ii) The board may grant a letter of authorization permitting a person with outstanding
             51      professional qualifications, including management experience and skills consistent with the
             52      mission of the Utah Schools for the Deaf and the Blind, to be appointed as superintendent.]
             53          [(c) The board shall establish the salary for the superintendent.]
             54          (b) The board shall make rules in accordance with Title 63G, Chapter 3, Utah
             55      Administrative Rulemaking Act, regarding the qualifications, terms of employment, and duties
             56      of the superintendent for the Utah Schools for the Deaf and the Blind.


             57          (3) The superintendent shall:
             58          (a) subject to the approval of the board, appoint an associate superintendent to
             59      administer the Utah School for the Deaf based on:
             60          (i) demonstrated competency as an expert educator of deaf persons; and
             61          (ii) knowledge of school management and the instruction of deaf persons;
             62          (b) subject to the approval of the board, appoint an associate superintendent to
             63      administer the Utah School for the Blind based on:
             64          (i) demonstrated competency as an expert educator of blind persons; and
             65          (ii) knowledge of school management and the instruction of blind persons, including an
             66      understanding of the unique needs and education of deafblind persons.
             67          [(3) (a)] (4) (a) The board shall:
             68          [(i) appoint members of the Advisory Council for the Utah Schools for the Deaf and
             69      the Blind; and]
             70          [(ii) receive and consider the recommendations and advice of the advisory council.]
             71          [(b) The board is not obligated to follow the recommendations of the advisory council.]
             72          (i) establish the Advisory Council for the Utah Schools for the Deaf and the Blind and
             73      appoint no more than 11 members to the advisory council;
             74          (ii) make rules in accordance with Title 63G, Chapter 3, Utah Administrative
             75      Rulemaking Act, regarding the operation of the advisory council; and
             76          (iii) receive and consider the advice and recommendations of the advisory council but
             77      is not obligated to follow the recommendations of the advisory council.
             78          (b) The advisory council described in Subsection (4)(a) shall include at least:
             79          (i) two members who are blind;
             80          (ii) two members who are deaf; and
             81          (iii) two members who are deafblind or parents of a deafblind child.
             82          [(4)] (5) The board shall approve the annual budget and expenditures of the Utah
             83      Schools for the Deaf and the Blind.
             84          (6) (a) On or before the November interim meeting each year, the board shall report to


             85      the Education Interim Committee on the Utah Schools for the Deaf and the Blind.
             86          (b) The report shall be presented verbally and in written form to the Education Interim
             87      Committee and shall include:
             88          (i) a financial report;
             89          (ii) a report on the activities of the superintendent and associate superintendents;
             90          (iii) a report on activities to involve parents and constituency and advocacy groups in
             91      the governance of the school; and
             92          (iv) a report on student achievement including:
             93          (A) student academic achievement data, including longitudinal data for both current
             94      and previous students served by the Utah Schools for the Deaf and the Blind;
             95          (B) graduation rates; and
             96          (C) students exiting the Utah Schools for the Deaf and the Blind and their educational
             97      placement after exiting the Utah Schools for the Deaf and the Blind.
             98          Section 2. Section 53A-25b-304 is amended to read:
             99           53A-25b-304. U-PASS testing.
             100          [(1)] The Utah Schools for the Deaf and the Blind shall annually administer, as
             101      applicable, the U-PASS tests specified in Section 53A-1-602 , except a student may take an
             102      alternative test in accordance with the student's IEP.
             103          [(2) By November 30 of each year, through 2011, the Utah Schools for the Deaf and
             104      the Blind shall report to the board and the Education Interim Committee the following data:]
             105          [(a) number of students served;]
             106          [(b) services provided;]
             107          [(c) student participation in state assessments;]
             108          [(d) academic achievement of students; and]
             109          [(e) the impact on enrollment at the Utah Schools for the Deaf and the Blind resulting
             110      from statutory changes regarding eligibility.]
             111          Section 3. Repealer.
             112          This bill repeals:


             113          Section 53A-25b-202, Authority and duties of the superintendent.
             114          Section 53A-25b-203, Advisory Council for the Utah Schools for the Deaf and the
             115      Blind.
