8 LONG TITLE
9 General Description:
10 This bill creates a pilot program in which grants are awarded to implement college and
11 career counseling.
12 Highlighted Provisions:
13 This bill:
14 . creates the College and Career Counseling Pilot Program to increase the number of
15 students pursuing post-secondary education and better prepare students for
16 post-secondary education;
17 . provides that money appropriated to the State Board of Education for the pilot
18 program shall be used to:
19 . award grants to local education agencies that have administrative control and
20 direction for public education (LEAs) or consortiums of LEAs to employ interns
21 who are candidates for a master's degree in guidance counseling to provide
22 college and career counseling; and
23 . provide training for the employed interns;
24 . directs the State Board of Education to make rules and report to the Education
25 Interim Committee; and
26 . repeals the College and Career Counseling Pilot Program on July 1, 2015.
27 Money Appropriated in this Bill:
28 This bill appropriates:
29 . to the State Board of Education - Utah State Office of Education - Initiative
30 Programs, as an ongoing appropriation for fiscal year 2012-13, $800,000 from the
31 Education Fund.
32 Other Special Clauses:
33 This bill provides an effective date.

40 Be it enacted by the Legislature of the state of Utah:
41 Section 1. Section 53A-17a-113.6 is enacted to read:
42 53A-17a-113.6. College and Career Counseling Pilot Program.
43 (1) As used in this section:
44 (a) "College and career counseling" includes:
45 (i) nurturing college aspirations;
46 (ii) assisting students in planning an academic program that connects to college and
47 career goals;
48 (iii) providing early and ongoing exposure to information necessary to make informed
49 decisions when selecting a college and career;
50 (iv) promoting participation in college and career assessments;
51 (v) providing financial aid information; and
52 (vi) increasing understanding about college admission processes.
53 (b) "LEA" means a local education agency that has administrative control and direction
54 for public education.
55 (c) "Pilot program" means the College and Career Counseling Pilot Program created in
56 this section.
57 (d) "Post-secondary education" means education or training for one or more years
58 directed to obtaining:
59 (i) a bachelor's or higher degree;
60 (ii) an associate's degree; or
61 (iii) a certificate, credential, or diploma.
62 (2) The College and Career Counseling Pilot Program is created to increase the number
63 of students who pursue post-secondary education after high school graduation and better
64 prepare students for success in post-secondary education.
65 (3) Subject to future budget constraints, the Legislature shall appropriate money for a
66 three-year period to the State Board of Education for the pilot program.
67 (4) The State Board of Education shall use money appropriated under Subsection (3)
68 to:
69 (a) award grants on a competitive basis to LEAs or consortiums of LEAs to employ
70 interns who are candidates for a master's degree in guidance counseling to provide college and
71 career counseling; and
72 (b) provide training for counselors employed under Subsection (4)(a) in college and
73 career counseling.
74 (5) (a) An LEA or a consortium of LEAs may apply for a grant awarded under
75 Subsection (4)(a).
76 (b) An applicant shall submit to the State Board of Education a plan for college and
77 career counseling integrating the services of an intern and other resources of the LEA or
78 consortium of LEAs.
79 (6) In awarding a grant under Subsection (4)(a), the State Board of Education shall
80 consider:
81 (a) the applicant's capacity to effectively achieve the purposes of the College and
82 Career Counseling Pilot Program as described in Subsection (2); and
83 (b) other criteria as determined by the State Board of Education.
84 (7) After each year of the pilot program, the State Board of Education shall make a
85 report to the Education Interim Committee evaluating the impact of the pilot program on
86 achieving the pilot program's purposes as stated in Subsection (2).
87 (8) The State Board of Education shall make rules specifying:
88 (a) procedures for applying for and awarding grants under this section;
89 (b) criteria for awarding grants; and
90 (c) reporting requirements for grantees.
91 Section 2. Section 63I-2-253 is amended to read:
92 63I-2-253. Repeal dates -- Titles 53, 53A, and 53B.
93 (1) Section 53A-1-403.5 is repealed July 1, 2012.
94 (2) Subsection 53A-1-603 (5) is repealed July 1, 2015.
95 (3) Title 53A, Chapter 1a, Part 10, UPSTART, is repealed July 1, 2014.
96 (4) Subsection 53A-13-110 (4) is repealed July 1, 2013.
97 (5) Section 53A-15-1215 is repealed July 1, 2012.
98 (6) Section 53A-17a-113.6 is repealed July 1, 2015.
99 Section 3. Appropriation.
100 Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the
101 following sums of money are appropriated from resources not otherwise appropriated out of the
102 funds or accounts indicated for the fiscal year beginning July 1, 2012, and ending June 30,
103 2013.

108 The Legislature intends that the $800,000 appropriation for Contracts and Grants be
109 used for the College and Career Counseling Pilot Program created in Section 53A-17a-113.6 .
110 Section 4. Effective date.
111 (1) Except as provided in Subsection (2), this bill takes effect on May 8, 2012.
112 (2) Uncodified Section 3, Appropriation, takes effect on July 1, 2012.
