             7      LONG TITLE
             8      General Description:
             9          This bill amends Title 63F, Chapter 1, Department of Technology Services, by
             10      establishing billing procedure and dispute requirements relating to the Department of
             11      Technology Services (department) and requiring reporting relating to acquisitions from
             12      the department.
             13      Highlighted Provisions:
             14          This bill:
             15          .    defines the term "technology or service item";
             16          .    establishes a billing and dispute process related to technology or service items
             17      provided by the department;
             18          .    requires an executive branch agency, other than the department, to annually report
             19      to the legislative appropriations subcommittee that makes budget recommendations
             20      for the executive branch agency, regarding the technology or service items acquired
             21      by the executive branch agency from the department; and
             22          .    requires an executive branch agency to establish an information technology steering
             23      committee.

             36      Be it enacted by the Legislature of the state of Utah:
             37          Section 1. Section 63F-1-901 is enacted to read:

Part 9. Miscellaneous Provisions

             39          63F-1-901. Title.
             40          This part is known as "Miscellaneous Provisions."
             41          Section 2. Section 63F-1-902 is enacted to read:
             42          63F-1-902. Definitions.
             43          As used in this part, "technology or service item" means information technology,
             44      equipment, and other items and services.
             45          Section 3. Section 63F-1-903 is enacted to read:
             46          63F-1-903. Billing by the department.
             47          (1) The department shall bill an executive branch agency for a technology or service
             48      item using a process that permits the executive branch agency to dispute the bill or a charge on
             49      the bill.
             50          (2) The Division of Finance shall mediate a dispute described in Subsection (1) if an
             51      agreement cannot be reached between the department and the executive branch agency.
             52          Section 4. Section 63F-1-904 is enacted to read:
             53          63F-1-904. Annual report by executive branch agencies.
             54          An executive branch agency, other than the department, shall annually report to the
             55      legislative appropriations subcommittee that makes budget recommendations for the executive
             56      branch agency, the following information:


             57          (1) the technology or service items purchased by the executive branch agency, from the
             58      department, during the most recently completed fiscal year;
             59          (2) the amount charged by the department for the technology or service items; and
             60          (3) whether the department provided a positive or negative value to the executive
             61      branch agency for the technology or service items provided by the department.
             62          Section 5. Section 63F-1-905 is enacted to read:
             63          63F-1-905. Information technology steering committees.
             64          (1) Each executive branch agency shall:
             65          (a) establish an information technology steering committee consisting of employees of
             66      the executive branch agency; and
             67          (b) provide an updated list of the members of the information technology steering
             68      committee to the department.
             69          (2) An information technology steering committee described in Subsection (1) shall:
             70          (a) assist the executive branch agency in developing an agency information technology
             71      plan described in Section 63F-1-204 ;
             72          (b) in providing the assistance described in Subsection (2)(a), consider the matters
             73      described in Subsection 63F-1-202 (3) as they relate to the executive branch agency; and
             74          (c) after reviewing bills submitted to the executive branch agency by the department,
             75      provide an opinion to the executive branch agency regarding whether the department provided
             76      a positive or negative value to the executive branch agency for the technology or service items
             77      provided by the department.
