8 General Description:
9 This bill establishes the crime of agricultural operation interference.
10 Highlighted Provisions:
11 This bill:
12 . defines "agricultural operation";
13 . provides that a person is guilty of agricultural operation interference if the person
14 records an image of, or sound from, an agricultural operation under certain
15 circumstances; and
16 . establishes penalties.

25 Be it enacted by the Legislature of the state of Utah:
26 Section 1. Section 76-6-112 is enacted to read:
27 76-6-112. Agricultural operation interference -- Penalties.
28 (1) As used in this section, "agricultural operation" means property used for the
29 production of livestock, poultry, livestock products, or poultry products.
30 (2) A person is guilty of agricultural operation interference if the person:
31 (a) without consent from the owner of the agricultural operation, or the owner's agent,
32 knowingly or intentionally records an image of, or sound from, the agricultural operation by
33 leaving a recording device on the agricultural operation;
34 (b) knowingly or intentionally records an image of, or sound from, an agricultural
35 operation while the person is lawfully present on the agricultural operation, after receiving
36 notice from the owner of the agricultural operation or the owner's agent that the person is
37 prohibited from recording an image of, or sound from, the agricultural operation; or
38 (c) without consent from the owner of the operation or the owner's agent, knowingly or
39 intentionally records an image of, or sound from, an agricultural operation while the person is
40 committing criminal trespass, as described in Section 76-6-206 , on the agricultural operation.
41 (3) A person who commits agricultural operation interference described in Subsection
42 (2)(a) is guilty of a class A misdemeanor.
43 (4) A person who commits agricultural operation interference described in Subsection
44 (2)(b) or (c) is guilty of a class B misdemeanor.
