             8      LONG TITLE
             9      General Description:
             10          This bill modifies the Minimum School Program Act regarding funding for a secondary
             11      school student who attends a campus of the Utah College of Applied Technology.
             12      Highlighted Provisions:
             13          This bill:
             14          .    provides that, beginning with the 2011-12 school year, a secondary student who
             15      attends a campus of the Utah College of Applied Technology is counted in the
             16      average daily membership of the sending school district or charter school;
             17          .    provides that a secondary student may attend a campus of the Utah College of
             18      Applied Technology if the student's technical education goals would be better
             19      achieved by attending the Utah College of Applied Technology as determined by
             20      the student's parent and, if the secondary student is a minor, the secondary student's
             21      parent or guardian;
             22          .    changes appropriations for certain programs within the basic school program and
             23      the flexible allocation program;
             24          .    sets the value of the weighted pupil unit at $2,842 for fiscal year 2012-13 for certain
             25      basic school programs; and


             26          .    makes technical amendments.
             27      Money Appropriated in this Bill:

             30          This bill provides an effective date.
             31          This bill provides for retrospective operation.
             32          This bill coordinates with S.B. 2 by providing superseding substantive amendments.
             33      Utah Code Sections Affected:
             34      AMENDS:
             35          53A-17a-114, as last amended by Laws of Utah 2011, Chapter 7

             37      Be it enacted by the Legislature of the state of Utah:
             38          Section 1. Section 53A-17a-114 is amended to read:
             39           53A-17a-114. Career and technical education program alternatives.
             40          [If a school district determines that a secondary student's career and technical education
             41      goals are better achieved at a regional applied technology college] (1) A secondary student
             42      may attend a campus of the Utah College of Applied Technology created under Title 53B,
             43      Chapter 2a, Utah College of Applied Technology, [the student may attend that institution.] if
             44      the secondary student's career and technical education goals are better achieved by attending
             45      the Utah College of Applied Technology as determined by:
             46          (a) the secondary student; and
             47          (b) if the secondary student is a minor, the secondary student's parent or legal guardian.
             48          (2) Beginning with the school year that occurs during the fiscal year that begins on July
             49      1, 2011 and ends on June 30, 2012, a secondary student served under this section in a campus
             50      of the Utah College of Applied Technology shall be counted in the average daily membership
             51      of the sending school district or charter school.
             52          Section 2. Appropriations for programs that support school districts and charter
             53      schools -- Value of the weighted pupil unit.
             54          (1) Under the terms and conditions of Utah Code Title 63J, Chapter 1, as applicable,
             55      the following sums of money are appropriated from resources not otherwise appropriated, or
             56      reduced from amounts previously appropriated, out of the funds or fund accounts indicated for


             57      distribution to state education agencies, school districts, and charter schools for the fiscal year
             58      beginning July 1, 2012 and ending June 30, 2013. These appropriations are additions to
             59      amounts previously appropriated for fiscal year 2012-13.
             60          (2) The value of each weighted pupil unit (WPU) for fiscal year 2012-13 is changed
             61      over the value of the WPU for fiscal year 2012-13 established in S.B. 2, Public Education
             62      Budget Amendments, for a total WPU value of:
             63          (a) $2,607 for:
             64          (i) Special Education - Add-on; and                    
             65          (ii) Career & Technical Ed District Add-on; and
             66          (b) $2,842 for all other programs.

             86          Section 3. Effective date -- Retrospective operation.
             87          (1) Except as provided in Subsection (2), this bill takes effect on May 8, 2012 and has


             88      retrospective operation to July 1, 2011.
             89          (2) Uncodified Section 2, Appropriation, takes effect on July 1, 2012.
             90          Section 4. Coordinating H.B. 206 with S.B. 2 -- Superseding substantive
             91      amendments.
             92          If this H.B. 206 and S.B. 2, Public Education Budget Amendments, both pass and
             93      become law, the Legislature intends that the value of each weighted pupil unit set in Subsection
             94      (2) of Uncodified Section 2, Appropriation, supersedes the value of each weighted pupil unit
             95      set in Subsection (2) of Section 5, Appropriation, in S.B. 2.
