             8      General Description:
             9          This bill creates an advisory committee on seismic safety issues in public schools.
             10      Highlighted Provisions:
             11          This bill:
             12          .    creates the Public School Seismic Safety Committee that shall advise and make
             13      recommendations to the Legislature, governor, state superintendent, and State Board
             14      of Education on seismic safety issues in public schools.

             23      Be it enacted by the Legislature of the state of Utah:
             24          Section 1. Section 53A-15-1301 is enacted to read:

Part 13. Public School Seismic Safety Committee

             26          53A-15-1301. Public School Seismic Safety Committee.
             27          (1) There is created the Public School Seismic Safety Committee consisting of seven


             28      members.
             29          (2) (a) The governor shall appoint three members who are licensed structural engineers,
             30      including:
             31          (i) one member from the public or private sector appointed from a list of at least two
             32      names submitted by the Utah Seismic Safety Commission;
             33          (ii) one member from the public or private sector appointed from a list of at least two
             34      names submitted by the state superintendent of public instruction; and
             35          (iii) one member from the public or private sector, after considering recommendations
             36      from professional associations representing structural engineers.
             37          (b) The state superintendent shall appoint four members, including:
             38          (i) one member representing a small school district;
             39          (ii) one member representing a medium-sized school district;
             40          (iii) one member representing a large school district; and
             41          (iv) one member from the state superintendent's staff.
             42          (3) (a) Except as required by Subsection (3)(b), each member is appointed to a
             43      four-year term.
             44          (b) The governor and state superintendent shall, at the time of appointment, adjust the
             45      length of terms to ensure that the terms of committee members are staggered so that
             46      approximately half of the committee is appointed every two years.
             47          (c) When a vacancy occurs in the membership for any reason, the replacement shall be
             48      appointed for the unexpired term in the same manner as the vacated member was chosen.
             49          (4) A member may not receive compensation or benefits for the member's service.
             50          (5) (a) The committee shall elect one of the members to serve as chair.
             51          (b) A majority of the members of the committee constitute a quorum of the committee.
             52          (c) The action of a majority of a quorum constitutes the action of the committee.
             53          (6) The state superintendent's staff shall provide staff support to the committee.
             54          (7) The committee shall advise and make recommendations to the Legislature,
             55      governor, state superintendent, and State Board of Education on seismic safety issues in public
             56      schools.
