7 LONG TITLE
8 General Description:
9 This bill amends the Professional Engineers and Professional Land Surveyors Licensing
10 Act by changing certain requirements for licensure as a land surveyor.
11 Highlighted Provisions:
12 This bill:
13 . requires that an applicant for licensure as a land surveyor:
14 . obtain a bachelor's, master's, or doctorate degree in a land surveying program; or
15 . obtain an associate's degree in a land surveying program, and meet certain other
16 requirements, before July 1, 2020; and
17 . makes technical changes.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 58-22-302 is amended to read:
28 58-22-302. Qualifications for licensure.
29 (1) [
30 (a) submit an application in a form prescribed by the division;
31 (b) pay a fee determined by the department under Section 63J-1-504 ;
32 (c) provide satisfactory evidence of good moral character;
33 (d) (i) have graduated and received a [
34 degree from an engineering program meeting criteria established by rule by the division in
35 collaboration with the board; or
36 (ii) have completed the Transportation Engineering Technology and Fundamental
37 Engineering College Program prior to July 1, 1998, under the direction of the Utah Department
38 of Transportation and as certified by the Utah Department of Transportation;
39 (e) have successfully completed a program of qualifying experience established by rule
40 by the division in collaboration with the board;
41 (f) have successfully passed examinations established by rule by the division in
42 collaboration with the board; and
43 (g) meet with the board or representative of the division upon request for the purpose
44 of evaluating the applicant's qualification for licensure.
45 (2) [
46 (a) submit an application in a form prescribed by the division;
47 (b) pay a fee determined by the department under Section 63J-1-504 ;
48 (c) provide satisfactory evidence of good moral character;
49 (d) have graduated and received an earned [
50 degree from an engineering program meeting criteria established by rule by the division in
51 collaboration with the board;
52 (e) have successfully completed three years of licensed professional engineering
53 experience established by rule by the division in collaboration with the board, except that prior
54 to January 1, 2009, an applicant for licensure may submit a signed affidavit in a form
55 prescribed by the division stating that the applicant is currently engaged in the practice of
56 structural engineering;
57 (f) have successfully passed examinations established by rule by the division in
58 collaboration with the board, except that prior to January 1, 2009, an applicant for licensure
59 may submit a signed affidavit in a form prescribed by the division stating that the applicant is
60 currently engaged in the practice of structural engineering; and
61 (g) meet with the board or representative of the division upon request for the purpose
62 of evaluating the applicant's qualification for licensure.
63 (3) [
64 (a) submit an application in a form prescribed by the division;
65 (b) pay a fee determined by the department under Section 63J-1-504 ;
66 (c) provide satisfactory evidence of good moral character;
67 (d) as established by division rule in collaboration with the board:
68 (i) have graduated and received a bachelor's, master's, or doctorate degree from a land
69 surveying program, or an equivalent land surveying program, and successfully completed a
70 program of qualifying experience in land surveying; or

80 (e) have successfully passed examinations established by rule by the division in
81 collaboration with the board; and
82 (f) meet with the board or representative of the division upon request for the purpose of
83 evaluating the applicant's qualification for licensure.
84 (4) Each applicant for licensure by endorsement shall:
85 (a) submit an application in a form prescribed by the division;
86 (b) pay a fee determined by the department under Section 63J-1-504 ;
87 (c) provide satisfactory evidence of good moral character;
88 (d) submit satisfactory evidence of:
89 (i) current licensure in good standing in a jurisdiction recognized by rule by the
90 division in collaboration with the board;
91 (ii) having successfully passed an examination established by rule by the division in
92 collaboration with the board; and
93 (iii) full-time employment as a principal for at least five of the last seven years
94 immediately preceding the date of the application as a:
95 (A) licensed professional engineer for licensure as a professional engineer;
96 (B) licensed professional structural engineer for licensure as a structural engineer; or
97 (C) licensed professional land surveyor for licensure as a professional land surveyor;
98 and
99 (e) meet with the board or representative of the division upon request for the purpose
100 of evaluating the applicant's qualifications for license.
101 (5) The rules made to implement this section shall be in accordance with Title 63G,
102 Chapter 3, Utah Administrative Rulemaking Act.
