AMENDMENTS TO DENTIST PRACTICE ACT

7 LONG TITLE
8 General Description:
9 This bill modifies Title 58, Chapter 69, Dentist and Dental Hygienist Practice Act, by
10 amending exemptions for licensure.
11 Highlighted Provisions:
12 This bill:
13 . permits an individual to practice dentistry without a Utah license S. [ if the individual: ]
13a under certain circumstances; and
14 . is invited by a Utah dental school to teach at the school;
15 . is licensed in good standing to practice dentistry in another state;
16 . renders services for an educational purpose; and
17 . does not engage in unlawful or unprofessional conduct; and ] .S
18 . makes technical changes.

27 Be it enacted by the Legislature of the state of Utah:

Section 1. Section 58-69-306 is amended to read:
29 58-69-306. Exemptions from licensure.
30 In addition to the exemptions from licensure in Section 58-1-307 :
31 (1) [a person] an individual performing mechanical work on inert matter in a laboratory
32 pursuant to a written prescription from a licensed dentist may engage in acts and practices
33 included in the practice of dentistry or dental hygiene without being licensed under this
34 chapter; S. [ [ ] and [ ] ] .S
35 (2) [a person] an individual licensed in good standing as a dentist in another state, with
36 no licensing action pending S. [ [ ] and no less than [ 10 ] 2 years of professional experience [ ] ] .S 36a , may engage
37 in the practice of dentistry without being licensed under this chapter if:
38 (a) the services are rendered as a public service and for a noncommercial purpose;
39 (b) no fee or other consideration of value is charged, received, expected, or
40 contemplated for the services rendered beyond an amount necessary to cover the proportionate
41 cost of malpractice insurance; and
42 (c) the individual does not otherwise engage in unlawful or unprofessional conduct S. [ [ ] . 42a [ ] ] [ ; ]
43 and
44 (3) an individual invited by a dental school in the state to teach dental school students
45 may engage in the practice of dentistry without being licensed under this chapter if the
46 individual:
47 (a) is licensed in good standing as a dentist in another state;
48 (b) renders services for an educational purpose; and
49 (c) does not otherwise engage in unlawful or unprofessional conduct. ] .S
