             7      LONG TITLE
             8      General Description:
             9          This bill amends provisions related to the duties of a conservation district and a
             10      conservation district board of supervisors.
             11      Highlighted Provisions:
             12          This bill:
             13          .    clarifies other statutory provisions that govern a conservation district;
             14          .    enacts language related to the fiscal year of a conservation district;
             15          .    authorizes the state auditor to modify requirements for a conservation district filing
             16      a budget or fiscal report;
             17          .    enacts language related to training provided for a member of a board of supervisors;
             18      and
             19          .    makes technical corrections.

             31      Be it enacted by the Legislature of the state of Utah:
             32          Section 1. Section 17D-3-105 is enacted to read:
             33          17D-3-105. Conservation districts subject to other provisions.
             34          (1) A conservation district is, to the same extent as if it were a local district, subject to
             35      and governed by:
             36          (a) Sections 17B-1-105 , 17B-1-107 , 17B-1-108 , 17B-1-109 , 17B-1-110 , 17B-1-112 ,
             37      17B-1-113 , 17B-1-116 , 17B-1-121 , 17B-1-307 , 17B-1-311 , 17B-1-313 , and 17B-1-314 ;
             38          (b) Title 17B, Chapter 1, Part 6, Fiscal Procedures for Local Districts;
             39          (c) Title 17B, Chapter 1, Part 7, Local District Budgets and Audit Reports;
             40          (d) Title 17B, Chapter 1, Part 8, Local District Personnel Management; and
             41          (e) Title 17B, Chapter 1, Part 9, Collection of Service Fees and Charges.
             42          (2) For purposes of applying the provisions listed in Subsection (1) to a conservation
             43      district, each reference in those provisions to the local district board of trustees means the
             44      board of supervisors described in Section 17D-3-301 .
             45          Section 2. Section 17D-3-106 is enacted to read:
             46          17D-3-106. Fiscal year.
             47          The fiscal year of a conservation district shall be, as determined by the commission:
             48          (1) the calendar year; or
             49          (2) a period beginning on July 1 and ending on the following June 30.
             50          Section 3. Section 17D-3-107 is enacted to read:
             51          17D-3-107. Annual budget and financial reports requirements.
             52          Upon agreement with the commission, the state auditor may modify:
             53          (1) for filing a budget, a requirement in Subsection 17B-1-614 (2) or 17B-1-629 (3)(d);
             54      or
             55          (2) for filing a financial report, a requirement in Section 17B-1-639 .
             56          Section 4. Section 17D-3-311 is enacted to read:
             57          17D-3-311. Training for board members.


             58          (1) A member of a board of supervisors shall, within one year after taking office,
             59      complete the training described in Subsection (2).
             60          (2) The state auditor shall, with the assistance of the commission and an association
             61      that represents conservation districts, develop a training curriculum for a member of the board
             62      of supervisors and conduct the training.
