             8      General Description:
             9          This bill provides funding for a public school reading program.
             10      Highlighted Provisions:
             11          This bill:
             12          .    requires the State Board of Education to select a technology provider through a
             13      request for proposals process to provide a computer software program for literacy
             14      instruction for students in kindergarten through grade 3.
             15      Money Appropriated in this Bill:
             16          This bill appropriates:
             17          .    To the State Board of Education -- State Office of Education -- Initiative Programs,
             18      as a one-time appropriation for fiscal year 2012-13:
             19              .    from the Education Fund, $3,000,000.
             20      Other Special Clauses:
             21          This bill provides an effective date.

             23      ENACTS:
             24          53A-17a-150.5, Utah Code Annotated 1953

             26      Be it enacted by the Legislature of the state of Utah:
             27          Section 1. Section 53A-17a-150.5 is enacted to read:


             28          53A-17a-150.5. K-3 Reading Improvement Program technology.
             29          (1) As used in this section, "K-3 Reading Improvement Program" means the K-3
             30      Reading Improvement Program described in Section 53A-17a-150 .
             31          (2) To improve reading skills for students in kindergarten through grade 3, and as part
             32      of the K-3 Reading Improvement Program, the board shall contract with a provider, selected
             33      through a request for proposals process, to provide a computer software program for literacy
             34      instruction for students in kindergarten through grade 3.
             35          (3) In evaluating proposals submitted under Subsection (2), the board shall ensure that
             36      the program includes:
             37          (a) individualized instruction to teach a student phonics, phonemic awareness,
             38      vocabulary, comprehension, and fluency;
             39          (b) internal assessments, tracking ability, and reports for teachers, administrators, and
             40      parents;
             41          (c) the ability to provide immediate feedback to students and facilitate remediation
             42      when needed;
             43          (d) integrated, computer pre- and post-assessment of a student's skills;
             44          (e) an assessment system that automatically determines a student's grade placement and
             45      instruction needs; and
             46          (f) grade-level appropriate digital books for a student to practice the student's reading
             47      skills on a computer.
             48          Section 2. Appropriation.
             49          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the
             50      following sums of money are appropriated from resources not otherwise appropriated, or
             51      reduced from amounts previously appropriated, out of the funds or accounts indicated for the
             52      fiscal year beginning July 1, 2012, and ending June 30, 2013. These are additions to any
             53      amounts previously appropriated for fiscal year 2013.
             54          To State Board of Education -- State Office of Education -- Initiative Programs

             58          The Legislature intends that:


             59          (1) the appropriation for Contracts and Grants be used for the purposes described in
             60      Section 53A-17a-150.5 ; and
             61          (2) the appropriation under this section:
             62          (a) be one-time; and
             63          (b) not lapse at the close of fiscal year 2013.
             64          Section 3. Effective date.
             65          (1) Except as provided in Subsection (2), this bill takes effect on May 8, 2012.
             66          (2) Uncodified Section 2, Appropriation, takes effect on July 1, 2012.
