             8      LONG TITLE
             9      General Description:
             10          This rules resolution provides a process for conducting a poll to determine legislators'
             11      preferences for candidates for United States Senate.
             12      Highlighted Provisions:
             13          This rules resolution:
             14          .    requires the Legislature to conduct an informal poll of its members regarding their
             15      preference among the declared candidates for any United States Senate seat that is
             16      up for election in any given election year;
             17          .    requires that the poll be conducted and completed within 30 days of the last day for
             18      declaring candidacy for the United States Senate;
             19          .    establishes that participation in the poll is voluntary;
             20          .    requires the Legislative Auditor General to administer and conduct the poll;
             21          .    requires that the poll be conducted by secret ballot; and
             22          .    requires the Legislative Auditor General to publicly release the total number of
             23      votes cast for each candidate.

             30      Be it resolved by the Legislature of the state of Utah:
             31          Section 1. JR1-4-201 is enacted to read:
             32     
Part 2. Informal Poll on United States Senate Candidates

             33          JR1-4-201. Informal poll on United States Senate candidates.
             34          (1) In a year where there is an election for a seat in the United States Senate, the Senate
             35      and the House of Representatives shall conduct an informal poll of their members to determine
             36      each member's preferred candidate for each seat that is up for election.
             37          (2) The poll required by this section shall:
             38          (a) be conducted and completed within 30 days of the last day for filing for the office
             39      of United States Senator, as provided in Section 20A-9-202 ;
             40          (b) be voluntary on the part of each senator or representative;
             41          (c) be administered by the Legislative Auditor General, who shall:
             42          (i) establish procedures and conduct the poll in a manner that assures that the poll is
             43      conducted fairly and accurately; and
             44          (ii) act subject to the direction of the Audit Subcommittee;
             45          (d) have a ballot containing the name of each person who has declared candidacy for
             46      the seat as of the conclusion of the last day for filing plus an option to select "none of the
             47      above"; and
             48          (e) be conducted by secret ballot.
             49          (3) Immediately after conducting the poll, the Legislative Auditor General shall make
             50      the results of the poll public by listing, for each seat that is up for election, the total number of
             51      votes cast for each candidate.
