Chair Powell called the meeting to order at 8:03 a.m.
MOTION: Rep. Galvez moved to approve the minutes of the February 14, 2012 meeting. The motion passed unanimously with Rep. Fisher, Rep. Oda, and Rep. Vickers absent for the vote.
S.B. 155 Transition for Repealed Navajo Trust Fund Act (Sen. D. Hinkins)
Sen Hinkins introduced the bill to the committee.
MOTION: Rep. Galvez moved to pass the bill out favorably. The motion passed unanimously with Rep. Fisher, Rep. Oda, and Rep. Vickers absent for the vote.
MOTION: Rep. Galvez moved to place S.B. 155 on the Consent Calendar. The motion passed unanimously with Rep. Fisher, Rep. Oda, and Rep. Vickers absent for the vote.
S.B. 159 State Fair Park Risk Management (Sen. L. Hillyard)
Sen. Hillyard introduced the bill, assisted by Tani Downing, Risk Management.
MOTION: Rep. Perry moved to pass the bill out favorably. The motion passed unanimously with Rep. Fisher, Rep. Oda, and Rep. Vickers absent for the vote.
MOTION: Rep. Greenwood moved to place S.B. 159 on the Consent Calendar. The motion passed unanimously with Rep. Oda and Rep. Vickers absent for the vote.
H.B. 283 State Stores Pilot Program for Days of Sale of Liquor (Rep. P. Arent)
Rep. Arent introduced the bill.
MOTION: Rep. Perry moved to amend the bill as follows:
1. Page 2, Line 56 through Page 3, Line 65 :
56 [
57 state store, and a state store may not be kept open for the sale of liquor on a state or federal
58 legal holiday, unless the commission allows by rule or order the sale or delivery of liquor on or
59 from the premises of a state store, or allows a state store to be kept open for sale of liquor on
60 the state or federal legal holiday[
61 (i) through a pilot program established by rule or order
and subject to Subsection
(5)(c)
; and
62 (ii) with the concurrence of the director.
(c) A pilot program established under Subsection (5)(b):
(i) may not allow the sale or delivery of liquor on or from the premises of a state store, or allow a state store to be kept open for sale of liquor on the following holidays:
(A) New Years;
(B) July 4;
(C) Thanksgiving; and
(D) Christmas; and
(ii) shall terminate on June 30, 2014.

65 the commission directs by rule or order.

implementation of the pilot program authorized by Subsection (5)(b).
SUBSTITUTE
MOTION: Rep. Frank moved to amend the amendment as follows:
Beginning on Line 62, after "Subsection (5)(b)", delete ":
(i) may not allow the sale or delivery of liquor on or from the premises of a state store, or allow a state store to be kept open for sale of liquor on the following holidays:
(A) New Years;
(B) July 4;
(C) Thanksgiving: and
(D) Christmas; and
(ii)"
The substitute motion failed with Rep. Frank, Rep. Perry, Rep. Oda, and Rep. Powell voting in favor of the motion.
The original motion to amend the bill passed unanimously.
