Chair Van Tassell called the meeting to order at 4:28 p.m.

Approval of Minutes

MOTION:
Sen. Mayne moved to approve the minutes of the February 17, 2012, meeting.         The motion passed unanimously with Sen. Jenkins absent for the vote.

S.B. 98    Amendments to Prohibition on Using a Handheld Wireless Communication Device While Operating a Vehicle (Sen. L. Hillyard)

Sen. Hillyard introduced and explained the bill and answered questions from the committee.

MOTION: Sen. Knudson moved to transmit S.B. 98 with a favorable recommendation. The         motion passed unanimously with Sens. Jenkins and Adams absent for the vote.

Sen. Knudson assumed the Committee Chair.

S.B. 244    Reporting Options for Auto Insurance (Sen. K. Van Tassell)

Sen. Van Tassell introduced and explained the bill assisted by Richard Kasteler, President/CEO Insure-Rite Inc.

Spoke for the bill:    Chris Purcell, State Farm Insurance

MOTION: Sen. Mayne moved to transmit S.B. 244 with a favorable recommendation. The         motion passed unanimously with Sen. Adams absent for the vote.

S.B. 199    Motor Vehicle Selling and Titling Requirements (Sen. S. Urquhart)


Sen. Adams assumed the committee chair.

MOTION: Sen. Van Tassell moved to adopt the following amendment:

1.    Page 4, Lines 91 through 93 :    

             91          (b) Subsection
{   (1)(a)   }        (2)(a)       does not apply to a personal representative, trustee, guardian,

             92      executor, administrator, sheriff, government entity, or other person who sells a vehicle, vessel,
             93      or outboard motor under the powers and duties granted or imposed by law.

2.    Page 4, Lines 100 through 104 :    

             100          (4) Unless the new owner is a person listed in Subsections (2)(a)(i) through (viii), the
             101     
{   new   }        owner of the       vehicle, vessel, or outboard motor      {   owner   } shall title the vehicle, vessel, or outboard motor

             102      by completing an application and presenting to the division a properly endorsed certificate of
             103      title, duplicate certificate of title, or other document of authority along with any additional
             104      documents the division may require to transfer the title.

3.    Page 4, Lines 111 through 112 :    

             111          (6) Nothing in this section applies to a person purchasing a vehicle from
{   an online   }        a motor vehicle      

             112      auction if the purchased vehicle is being transported out of the state.

The motion passed unanimously.

Wayne Jones, Executive Director, Independent Auto Dealers explained the bill.

MOTION: Sen. Knudson moved to transmit S.B. 199 with a favorable recommendation. The         motion passed unanimously.

MOTION:
Sen. Van Tassell moved to place S.B. 199 on the Consent Calendar. The motion         passed unanimously.


Sen. Van Tassell resumed the Committee Chair.

MOTION:
    Sen. Adams moved to adjourn. The motion passed unanimously. Chair Van Tassell adjourned the meeting at 4:59 p.m.
