Chair Van Tassell called the meeting to order at 4:20 p.m.

Approval of Minutes

MOTION:    
Sen. Knudson moved to approve minutes of the February 22, 2012, meeting.     The motion passed unanimously with Sens. Mayne and Jenkins absent for the vote.

S.B. 255    Vehicle Salvage Amendments (Sen. C. Bramble)

Sen. Bramble introduced and explained the bill.

MOTION:
Sen. Adams moved to amend the bill as follows:


1.    Page 3, Lines 70 through 71 :    

             70          (c) (i) When a salvage vehicle is not the subject of an insurance settlement,
{  [   } a

             71      self-insurer or
{  ]   } an owner who is uninsured shall within 10 days of the      {  theft or major   } damage


2.    Page 4, Lines 91 through 95 :    

             91          (5)
{  (a)   } Except as provided in Subsection (1), this chapter does not apply to a motor

             92      vehicle that has been stolen or taken without the consent of the owner until the motor vehicle
             93      has been recovered
{  [   } , and then it applies only if the motor vehicle is a salvage vehicle      {  ]   } .

The motion passed unanimously with Sen. Jenkins absent for the vote.

MOTION: Sen. Knudson moved to transmit S.B. 255 with a favorable recommendation. The         motion passed unanimously with Sen. Jenkins absent for the vote.

MOTION: Sen. Knudson moved to place S.B. 255 as amended on the Consent Calendar. The         motion passed unanimously with Sen. Jenkins absent for the vote.

H.B. 268    Driver License Amendments (Rep. V. Peterson)

Rep. Peterson introduced and explained the bill.

MOTION: Sen. Mayne moved to transmit H.B. 268 with a favorable recommendation. The         motion passed unanimously with Sen. Jenkins absent for the vote.

MOTION: Sen. Adams moved to place H.B. 268 on the Consent Calendar. The motion         passed unanimously with Sen. Jenkins absent for the vote.

S.B. 237    Personal Injury Protection Insurance Amendments (Sen. A. Christensen)

Sen. Christensen introduced and explained the bill assisted by Dr. Matthew Roller, President, Utah Chiropractic Physicians Association.

MOTION: Sen. Adams moved to adopt the following amendments:

1.    Page 1, Line 20 :    

             20              .    the insurer that provides the personal injury protection coverage
{   .   }        ;

    . provides that the medical provider will accept the payments made pursuant to the Utah RVS fee schedule for covered services as full and final payment and may not submit the balance of the bill to the patient; and
    . provides that the original amount of the medical provider's bill shall be used for purposes of determining whether a person who has or is required to have direct benefit coverage under a policy which includes personal injury protection may maintain a cause of action for general damages arising out of personal injuries

alleged to have been caused by an automobile accident.  



2.    Page 4, Line 94 :    

             94          (ii) the insurer that provides the personal injury protection coverage.
    
  (g)(i) The medical provider will accept the payments made pursuant to the Utah RVS fee schedule for covered services as full and final payment and may not submit the balance of the bill to the patient.

    (ii) The original amount of the medical provider's bill shall be used for purposes of determining whether the requirement of Section 31A-22-309(1)(a)(v) has been met.  


The motion passed unanimously.

MOTION: Sen. Adams moved to go to the next item on the agenda.

SUB. MOTION: Sen. Knudson moved to transmit S.B. 237 with a favorable recommendation.      The motion failed with Sens. Mayne and Knudson voting in favor of the              bill and Sens. Van Tassell, Jenkins, and Adams voting against it.

S.B. 225    Transportation Revisions (Sen. J. S. Adams)

Sen. Adams introduced and explained the bill.

Linda Hull, Utah Department of Transportation further explained the bill.



MOTION: Sen. Adams moved to transmit S.B. 225 with a favorable recommendation.
        The motion passed unanimously.

MOTION: Sen. Knudson moved to place S.B. 225 on the Consent Calendar. The motion         passed unanimously.

2nd Sub. H.J.R. 6 Joint Resolution on Severance Tax (J. Nielson)

MOTION:
Sen. Jenkins moved to adopt 3rd Sub. H.J.R. 6. The motion passed unanimously.

Rep. Nielson introduced and explained the resolution.

MOTION: Sen. Knudson moved to transmit 3rd Sub. H.J.R. 6 with a favorable         recommendation. The motion passed unanimously.

    Sen. Knudson moved to adjourn. The motion passed unanimously. Chair Van Tassell adjourned the meeting at 5:32 p.m.
