             16      LONG TITLE
             17      General Description:
             18          This bill amends the Health Code related to the state Medicaid program by prohibiting
             19      the expansion of the Medicaid program under certain circumstances.
             20      Highlighted Provisions:
             21          This bill:
             22          .    defines terms;
             23          .    prohibits the Department of Health or the governor from expanding the state
             24      Medicaid program to optional expansion populations unless:


             25              .    the Health System Reform Task Force completes a review of a statewide charity
             26      care system;
             27              .    the department completes a thorough analysis of the impact of Medicaid
             28      expansion in the state and makes the analysis available to the public; and
             29              .    the department reports to the Legislature in accordance with statutory reporting
             30      requirements.

             36      ENACTS:
             37          26-18-18, Utah Code Annotated 1953

             39      Be it enacted by the Legislature of the state of Utah:
             40          Section 1. Section 26-18-18 is enacted to read:
             41          26-18-18. Optional Medicaid expansion.
             42          (1) For purposes of this section PPACA is as defined in Section 31A-1-301 .
             43          (2) The department and the governor shall not expand the state's Medicaid program to
             44      the optional population under PPACA unless:
             45          (a) the Health System Reform Task Force has completed a thorough analysis of a
             46      statewide charity care system;
             47          (b) the department and its contractors have:
             48          (i) completed a thorough analysis of the impact to the state of expanding the state's
             49      Medicaid program to optional population under PPACA; and
             50          (ii) made the analysis conducted under Subsection (2)(b)(i) available to the public;
             51          (c) the S. [ department ] governor or the governor's designee .S has reported S. [ its ]
             51a      the .S intention to expand the state Medicaid program
             52      under PPACA to the Legislature in compliance with the legislative review process in Sections
             53      63M-1-2505.5 and 26-18-3 ; and
             54          (d) notwithstanding Subsection 63 S. J .S -5-103 (2), the governor submits the request
             54a      for
             55      expansion of the Medicaid program for optional populations to the Legislature under the high


             56      impact federal funds request process required by Section 63J-5-204 , Legislative review and
             57      approval of certain federal funds request.
             57a           S. Section 2. Effective date.
             57b          If approved by two-thirds of all the members elected to each house, this bill takes effect
             57c      upon approval by the governor, or the day following the constitutional time limit of Utah
             57d      Constitution Article VII, Section 8, without the governor's signature, or in the case of veto, the
             57e      date of veto override. .S
