The Executive Appropriations Committee recommended this bill.
General Description:
This bill supplements or reduces appropriations previously provided for the use and operation
of state government for the fiscal year beginning July 1, 2012 and ending June 30, 2013.
Highlighted Provisions:
This bill:
. provides budget increases and decreases for the use and support of certain state agencies;
. provides budget increases and decreases for the use and support of certain institutions of
higher education;
. provides budget increases and decreases for other purposes as described.
Money Appropriated in this Bill:
This bill appropriates $207,576,700 in operating and capital budgets for fiscal year 2013,
including:
. ($35,004,800) from the General Fund;
. $242,581,500 from various sources as detailed in this bill.
This bill appropriates $80,006,800 in business-like activities for fiscal year 2013.
This bill appropriates $47,998,200 in restricted fund and account transfers for fiscal year
2013, including:
. $1,214,000 from the General Fund;
. $46,784,200 from various sources as detailed in this bill.
This bill appropriates $34,122,000 in transfers to unrestricted funds for fiscal year 2013.
This bill appropriates $243,305,200 in capital project funds for fiscal year 2013.
Other Special Clauses:
This bill takes effect immediately.

Be it enacted by the Legislature of the state of Utah:
Section 1. FY 2013 Appropriations. The following sums of money are appropriated for the fiscal year beginning July 1, 2012 and ending June 30, 2013. These are additions to amounts previously appropriated for fiscal year 2013.
Subsection 1(a). Operating and Capital Budgets. Under the terms and conditions of Utah Code Title 63J, the Legislature appropriates the following sums of money from the funds or fund accounts indicated for the use and support of the government of the State of Utah.

Under Section 63J-1-603 of the Utah Code, the Legislature intends that appropriations provided for the Division of Juvenile Justice services line item in Item 21 of Chapter 11, Laws of Utah 2012, not lapse at the close of Fiscal Year 2013. The use of any nonlapsing funds is limited to expenditures for data processing and technology based expenditures, facility repairs and maintenance and improvements, other charges and pass through expenditures, and short-term projects and studies that promote efficiency and service improvement.
Notwithstanding the intent language authorized by the Legislature in Item 21 of Chapter 422, Laws of Utah 2012, the Legislature intends that the Division of Juvenile Justice Services may use nonlapsing balances to operate the Weber Valley Detention Center through the end of the fiscal year 2013.

The Legislature intends that up to $8,500,000 from the Statewide Unified E-911 Emergency Service Account, $3,500,000 from dedicated credits, and $11,000,000 from General Fund and restricted General Fund of the appropriations provided for Programs and Operations not lapse at the close of Fiscal Year 2013. The use of any unused funds is limited to facility construction, capital equipment or improvements, computer equipment/software/programming, law enforcement overtime, employee training, equipment and supplies, grant obligations, and operations.
The Legislature intends that Public Safety is allowed to increase its fleet by 4 vehicles due to the expansion of Liquor Law Enforcement Agents funded during the 2012 special session. Funding for the vehicles will be provided from the Alcoholic Beverage Control Act Enforcement Fund.
Item 27 To Department of Public Safety - Emergency Management
Under section 63J-1-603 of the Utah Code, the Legislature intends that appropriations of up to $500,000 provided for Emergency Services and Homeland Security in Item 28 of Chapter 11 Laws of Utah 2012 not lapse at the close of fiscal year 2013. The use of any unused funds is limited to search and
rescue reimbursement, computer
equipment/software/programming, employee training, and
equipment and supplies.

intends that up to $500,000 of the appropriations from the
Uninsured Motorist Identification Restricted Account provided
for Driver License not lapse at the close of Fiscal Year 2013.
The use of any unused funds is limited to the uninsured
motorist database program.

The use of any nonlapsing funds is limited to the following: customer service and Department optimization projects, shared services, IT security auditing and prevention, internal auditing, website maintenance, and marketing - $95,000; Child Welfare Parental Defense expenses - $60,000.
Item 40 To Department of Administrative Services - DFCM Administration
The Legislature intends that the Division of Facilities Construction and Management may add one additional vehicle to its authorized level using existing funds. Any added vehicles must be reviewed and approved by the Legislature.
Under Section 63J-1-603 of the Utah Code the Legislature intends that appropriations provided for DFCM Administration in Item 15 of Chapter 12 and Item 57 of Chapter 46 Laws of Utah 2012 not lapse at the close of Fiscal Year 2013. The use of any nonlapsing funds is limited to the following: information technology projects, customer service, optimization efficiency projects, time limited FTE and Governors Mansion maintenance - $400,000; Energy Program operations - $300,000.

Under Section 63J-1-603 of the Utah Code, the Legislature intends that appropriations provided for State Archives in Item 16 of Chapter 12 Laws of Utah 2012 not lapse at the close of Fiscal Year 2013. The use of any nonlapsing funds is limited to the following: regional repository program support, electronic archives preservation and management - $50,000.
Item 42 To Department of Administrative Services - Finance Administration
Under Section 63J-1-603 of the Utah Code the Legislature intends that appropriations provided for Finance Administration in Item 17 of Chapter 12 Laws of Utah 2012 not lapse at the close of Fiscal Year 2013. The use of any nonlapsing funds is limited to the following: maintenance and
operation of statewide systems and websites, studies, training,
and information technology support and hardware -
$2,200,000.
Under Section 63J-1-603 of the Utah Code the Legislature
intends that remaining funds appropriated for FY 2013 for
Local Government Transparency in the Department of
Administrative Services are nonlapsing.

Development Tax Increment Fund (EDTIF) not lapse at the
close of Fiscal Year 2013.

Indigent Defense
Under Section 63J-1-603 of the Utah Code the Legislature
intends that appropriations provided for Post Conviction in
Item 20 of Chapter 12 Laws of Utah 2012 not lapse at the close
of Fiscal Year 2013. The use of any nonlapsing funds is limited
to the following: Legal costs for death row inmates - $150,000.
Item 45 To Department of Administrative Services - Judicial Conduct
Commission
Under Section 63J-1-603 of the Utah Code the Legislature
intends that appropriations provided for Judicial Conduct
Commission in Item 21 of Chapter 12 Laws of Utah 2012 not
lapse at the close of Fiscal Year 2013. The use of any
nonlapsing funds is limited to the following: professional
services for Investigations - $80,000.
Item 46 To Department of Administrative Services - Purchasing
Under Section 63J-1-603 of the Utah Code the Legislature
intends that appropriations provided for Purchasing in Item 22
of Chapter 12 Laws of Utah 2012 not lapse at the close of
Fiscal Year 2013. The use of any nonlapsing funds is limited to
the following; on-line procurement training for procurement for
purchasing agents making small purchases - new requirement
by statute, office remodeling to relocate purchasing agents from
5th floor of SOB to 3rd floor, and upgrade to States on-line
bidding system - $200,000.

Under Section 63J-1-603 of the Utah Code, the Legislature intends that appropriations provided for the Department of Technology Services Chief Information Officer not lapse at the close of Fiscal Year 2013. The use of any nonlapsing funds is limited to the following: Data Processing Current Expenses for optimization initiatives - $30,000.

not lapse at the close of Fiscal Year 2013. These funds will be
used for digitization projects and maintenance.
Under Section 63J-1-603 of the Utah Code, the Legislature
intends that up to $116,900 of any remaining amount of the
$2,861,600 ongoing General Fund appropriation provided by
Item 1, Chapter 10, Laws of Utah 2012 for the Department of
Community and Culture (Heritage and Arts) - Administration
not lapse at the close of Fiscal Year 2013. These funds will be
used for application development payments to DTS.
Under Section 63J-1-603 of the Utah Code, the Legislature
intends that any remaining amount of the $254,100 ongoing
General Funds and $30,000 Dedicated Credits provide by item
66, Chapter 417 Laws of Utah 2012 for the Department of
Community and Culture (Heritage and Arts) - Multicultural
Commission not lapse at the close of Fiscal Year 2013

intends that the $102,000 in Dedicated Credits provided by

Section 2. Effective Date.
If approved by two-thirds of all the members elected to each house, this bill takes effect upon approval by the Governor, or the day following the constitutional time limit of Utah Constitution Article VII, Section 8 without the Governor's signature, or in the case of a veto, the date of override.
