             15      LONG TITLE
             16      General Description:
             17          This bill allows certain students to fish without a license under certain circumstances.
             18      Highlighted Provisions:
             19          This bill:
             20          .    defines the term "school";
             21          .    allows certain students to fish without a license under certain circumstances; and
             22          .    makes technical changes.

             31      Be it enacted by the Legislature of the state of Utah:
             32          Section 1. Section 23-19-14.5 is amended to read:
             33           23-19-14.5. Persons participating in youth organization or school activity
             34      authorized to fish without license.
             35          (1) As used in this section[,]:
             36          (a) "School" means an elementary school or a secondary school that:
             37          (i) is a public or private school located in the state; and
             38          (ii) provides student instruction for one or more years of kindergarten through grade 9.
             39          (b) "Youth organization" means a local Utah chapter of:
             40          [(a)] (i) the Boy Scouts of America;
             41          [(b)] (ii) the Girls Scouts of the USA; or
             42          [(c)] (iii) an organization that:
             43          [(i)] (A) is exempt from taxation under Section 501(c)(3), Internal Revenue Code; and
             44          [(ii)] (B) promotes character building through outdoor activities.
             45          (2) The Division of Wildlife Resources shall permit a [resident] person to fish without
             46      a license during a youth organization or school activity if:
             47          (a) the [resident] person is:
             48          (i) (A) a member of [a] the youth organization; [and] or
             49          (B) a student enrolled in the school; and
             50          (ii) younger than 14 years old;
             51          (b) the fishing is in compliance with all fishing statutes and rules; [and]
             52          (c) the activity is part of a recreational or instructional program of the youth
             53      organization or school; and
             54          [(c) the] (d) an adult leader of the activity obtains from the youth organization or
             55      school:
             56          (i) a valid tour permit; or


             57          (ii) [official] documentation that specifies:
             58          (A) the date and place of the fishing activity;
             59          (B) the name of the adult leader that will supervise the fishing; and
             60          (C) that the activity is officially sanctioned or authorized by the youth organization or
             61      school.
             62          (3) (a) The adult leader shall instruct the [members] activity participants on fishing
             63      statutes and rules.
             64          (b) The division shall provide educational materials on its website to assist the adult
             65      leader in complying with Subsection (3)(a).
             66          (4) [By following the procedures and requirements of] In accordance with Title 63G,
             67      Chapter 3, Utah Administrative Rulemaking Act, the Wildlife Board shall adopt rules
             68      specifying the form of the [official] documentation required [by] under Subsection
             69      (2)[(c)](d)(ii).
