9 General Description:
10 This bill modifies a committee to create the Snow College Economic Development and
11 Workforce Preparation Advisory Committee.
12 Highlighted Provisions:
13 This bill:

15 Advisory Committee by modifying the name, membership, and duties of the Snow

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 53B-2a-103 is amended to read:
28 53B-2a-103. Utah College of Applied Technology Board of Trustees --
29 Membership -- Terms -- Vacancies -- Oath -- Officers -- Quorum -- Committees --
30 Compensation.
31 (1) There is created the Utah College of Applied Technology Board of Trustees,
32 composed of the following members:
33 (a) one member of the State Board of Education appointed by the chair of the State
34 Board of Education, to serve as a nonvoting member;
35 (b) one member of the State Board of Regents appointed by the chair of the State
36 Board of Regents, to serve as a nonvoting member;
37 (c) one member representing business and industry employers from the campus board
38 of directors of each applied technology college campus appointed by a majority vote of the
39 business and industry employer members of the campus board;
40 (d) one member representing business and industry employers from the Snow College
41 [
42 Preparation Advisory Committee appointed by a majority of the business and industry
43 employer members of the advisory committee;
44 (e) one member representing business and industry employers from the Utah State
45 University-College of Eastern Utah career and technical education advisory committee
46 appointed by a majority of the business and industry employer members of the advisory
47 committee;
48 (f) one member representing business and industry employers from the Salt Lake
49 Community College School of Applied Technology Board of Directors appointed by a majority
50 of the business and industry employer members of the board of directors;
51 (g) one business or industry employer representative appointed by the governor with
52 the consent of the Senate from nominations submitted by the speaker of the House of
53 Representatives and president of the Senate;
54 (h) one representative of union craft, trade, or apprenticeship programs that prepare
55 workers for employment in career and technical education fields, appointed by the governor
56 with the consent of the Senate;
57 (i) one representative of non-union craft, trade, or apprenticeship programs that prepare
58 workers for employment in career and technical education fields, appointed by the governor
59 with the consent of the Senate;
60 (j) the commissioner of higher education; and
61 (k) the executive director of the Governor's Office of Economic Development or the
62 executive director's designee.
63 (2) (a) In making appointments to the board of trustees, the governor shall consider:
64 (i) individuals from the state at large with due consideration for geographical
65 representation;
66 (ii) individuals recognized for their knowledge and expertise; and
67 (iii) individuals who represent current and emerging business and industry sectors of
68 the state.
69 (b) Appointments to the board shall be made on a nonpartisan basis.
70 (3) (a) Except as provided under Subsection (3)(b), members of the board of trustees
71 shall be appointed commencing on July 1 of each odd-numbered year to a four-year term.
72 (b) Initial terms of the board members beginning on July 1, 2009 shall be staggered
73 with two-year and four-year terms so that approximately one-half of the members' terms will
74 expire in any odd-numbered year.
75 (c) An appointed member holds office until a successor is appointed and qualified.
76 (4) When a vacancy occurs in the membership for any reason, the replacement shall be
77 appointed for the unexpired term.
78 (5) (a) Each member shall take the official oath of office prior to assuming the office.
79 (b) The oath shall be filed with the Division of Archives and Records Services.
80 (6) The board of trustees shall elect a chair and vice chair, who serve for two years and
81 until their successors are elected and qualified.
82 (7) (a) The board of trustees may enact bylaws for its own government, including
83 provision for regular meetings.
84 (b) (i) The board of trustees may provide for an executive committee in its bylaws.
85 (ii) If established, the committee shall have full authority of the board of trustees to act
86 upon routine matters during the interim between board of trustees meetings.
87 (iii) The committee may act on nonroutine matters only under extraordinary and
88 emergency circumstances.
89 (iv) The committee shall report its activities to the board of trustees at its next regular
90 meeting following the action.
91 (8) A quorum shall be required to conduct business which shall consist of a majority of
92 voting board of trustee members.
93 (9) The board of trustees may establish advisory committees.
94 (10) A member may not receive compensation or benefits for the member's service, but
95 may receive per diem and travel expenses in accordance with:
96 (a) Section 63A-3-106 ;
97 (b) Section 63A-3-107 ; and
98 (c) rules made by the Division of Finance pursuant to Sections 63A-3-106 and
99 63A-3-107 .
100 Section 2. Section 53B-16-206 is amended to read:

127 members appointed under Subsections (1)(a) through [
128 (h) one public education school district superintendent, appointed by the Snow College
129 Board of Trustees, chosen from the school district superintendents serving in the Juab, Millard,
130 Tintic, North Sanpete, South Sanpete, Wayne, Piute, and Sevier School Districts; and
131 (i) one public education school district career and technical education director,
132 appointed by the Snow College Board of Trustees, chosen from the career and technical
133 education directors serving in the Juab, Millard, Tintic, North Sanpete, South Sanpete, Wayne,
134 Piute, and Sevier School Districts.
135 (2) (a) Except as provided in Subsection (2)(b), a member of the Snow College
136 Economic Development and Workforce Preparation Advisory Committee shall serve for a term
137 of four years.
138 (b) The president of Snow College shall adjust the length of the terms to ensure that the
139 terms of committee members are staggered so that approximately half of the committee
140 members are appointed every two years.
141 (3) The members of the Snow College Economic Development and Workforce
142 Preparation Advisory Committee shall elect a chair of the committee from the committee's
143 membership.
144 (4) The Snow College Economic Development and Workforce Preparation Advisory
145 Committee shall meet upon the call of the chair or a majority of the committee members.

147 Economic Development and Workforce Preparation Advisory Committee shall:
148 (a) assess the economic development needs of central Utah and advise Snow College
149 on how the college can improve the effectiveness of its efforts to assist business, industry, and
150 local governments in efforts to expand economic activity and enhance the local economy; and
151 (b) review educational programs offered by Snow College, including career and
152 technical education programs, and advise Snow College on how the college can improve its
153 efforts to prepare students for employment in the region and enhance the skills of workers who
154 are already employed.
