10 General Description:
11 This bill modifies the Hearing Instrument Specialist Licensing Act and modifies the
12 repeal date of the Hearing Instrument Specialist Licensing Act in the Legislative
13 Oversight and Sunset Act.
14 Highlighted Provisions:
15 This bill:
16 . modifies the requirements for obtaining a license as a hearing instrument specialist
17 and a hearing instrument intern by removing prerequisite hours of practice;
18 . changes the repeal date of Title 58, Chapter 46a, Hearing Instrument Specialist
19 Licensing Act in the Legislative Oversight and Sunset Act from July 1, 2013, to
20 July 1, 2023;
21 . repeals provisions regarding licenses prior to 2002 that are no longer applicable; and
22 . makes technical changes.

35 Be it enacted by the Legislature of the state of Utah:
36 Section 1. Section 58-46a-302 is amended to read:
37 58-46a-302. Qualifications for licensure.
38 (1) Each applicant for licensure as a hearing instrument specialist shall:
39 (a) submit to the division an application in a form prescribed by the division;
40 (b) pay a fee as determined by the division pursuant to Section 63J-1-504 ;
41 (c) be of good moral character;

49 for Certification - Hearing Instrument Sciences, or an equivalent certification approved by the
50 division in collaboration with the board;

52 Specialists; and

54 instrument intern license at the time of licensure as a hearing instrument specialist.
55 (2) Each applicant for licensure as a hearing instrument intern shall:
56 (a) submit to the division an application in a form prescribed by the division;
57 (b) pay a fee as determined by the division pursuant to Section 63J-1-504 ;
58 (c) be of good moral character;
59 (d) have passed the Utah Law and Rules Examination for Hearing Instrument
60 Specialists; and
61 (e) present evidence acceptable to the division and the board that the applicant, when
62 licensed, will practice as a hearing instrument intern only under the supervision of a
63 supervising hearing instrument specialist [
64 with:
65 (i) Section 58-46a-302.5 ; and
66 (ii) the supervision requirements for obtaining board certification by the National
67 Board for Certification - Hearing Instrument Sciences, or an equivalent certification approved
68 by the division in collaboration with the board.
69 Section 2. Section 58-46a-302.5 is amended to read:
70 58-46a-302.5. Supervision requirements -- Hearing instrument interns.
71 (1) A hearing instrument intern shall [

73 practice as a hearing instrument intern only under the direct supervision of a licensed hearing
74 instrument specialist, until the intern:
75 (a) receives a passing score on a practical examination demonstrating acceptable skills
76 in the area of hearing testing as approved by the division in collaboration with the board; and
77 (b) completes the National Institute for Hearing instrument studies education and
78 examination program, or an equivalent college level program as approved by the division in
79 collaboration with the board.

81 the intern shall:
82 (a) [
83 instrument intern only under the indirect supervision of a licensed hearing instrument
84 specialist; and
85 (b) receive a passing score on the International Licensing Examination of the hearing
86 instrument dispenser or other tests approved by the division prior to applying for licensure as a
87 hearing instrument specialist.
88 Section 3. Section 63I-1-258 is amended to read:
89 63I-1-258. Repeal dates, Title 58.
90 (1) Title 58, Chapter 9, Funeral Services Licensing Act, is repealed July 1, 2018.
91 (2) Title 58, Chapter 13, Health Care Providers Immunity from Liability Act, is
92 repealed July 1, 2016.
93 (3) Title 58, Chapter 15, Health Facility Administrator Act, is repealed July 1, 2015.
94 (4) Section 58-17b-309.5 is repealed July 1, 2015.
95 (5) Title 58, Chapter 20a, Environmental Health Scientist Act, is repealed July 1, 2013.
96 (6) Title 58, Chapter 40, Recreational Therapy Practice Act, is repealed July 1, 2023.
97 (7) Title 58, Chapter 41, Speech-language Pathology and Audiology Licensing Act, is
98 repealed July 1, 2019.
99 (8) Title 58, Chapter 42a, Occupational Therapy Practice Act, is repealed July 1, 2015.
100 (9) Title 58, Chapter 46a, Hearing Instrument Specialist Licensing Act, is repealed July
