7 LONG TITLE
8 General Description:
9 This rules resolution amends joint legislative rules governing procedures for reviewing
10 certain bills with fiscal notes.
11 Highlighted Provisions:
12 This resolution:
13 . provides a process for the Executive Appropriations Committee to direct, based
14 upon strong public policy values and fiscal management considerations, that a fiscal
15 note on legislation be:
16 . reprioritized for funding; or
17 . paid for using existing budget resources rather than a new appropriation;
18 . allows a legislator to request that the Executive Appropriations Committee consider
19 one of the two above options; and
20 . permits the Executive Appropriations Committee to release a bill from fiscal note
21 holding procedures and direct the entities affected by the bill to use existing
22 resources to pay for the estimated fiscal impact of the bill, as necessary.

29 Be it resolved by the Legislature of the state of Utah:
30 Section 1. JR4-5-101 is amended to read:
31 JR4-5-101. Deadline for Passing Certain Fiscal Note Bills -- Holding and Release
32 of Bills Having Large Fiscal Notes.
33 (1) (a) Bills having a high fiscal note shall be held for review as follows:
34 (i) The House shall refer any Senate bill with a fiscal note of $10,000 or more to the
35 House Rules Committee before giving that bill a third reading.

38 (2) (a) The Executive Appropriations Committee may, on its own discretion or at the
39 request of a legislator, and based upon strong public policy values and fiscal management
40 considerations, direct that legislation with a fiscal note be released from a hold with a directive
41 that all costs of the legislation be paid for using existing budget resources rather than a new
42 appropriation or through reprioritzation of funds.
43 (b) If the Executive Appropriations Committee, by a majority vote, grants the
44 legislator's request, it may either:
45 (i) reprioritize the request and give it priority for funding; or
46 (ii) approve the release of the hold by:
47 (A) amending the fiscal note to show the Executive Appropriations Committee's
48 recommendation that existing resources be used to pay for the estimated fiscal impact;
49 (B) preparing intent language to require all entities affected by the bill to use existing
50 budget resources to pay for the estimated fiscal impact of the bill; and
51 (C) releasing the bill from the hold imposed under Subsection (1)(a).

53 legislator shall prioritize fiscal note bills and identify other projects or programs for new or
54 one-time funding according to the process established by leadership.
55 (b) Before adjourning on the 39th day of the annual general session, the Legislature
56 shall either pass or defeat each bill with a fiscal note of $10,000 or more except constitutional
57 amendment resolutions.
