8 General Description:
9 This bill enacts the Outdoor Recreation Office Act.
10 Highlighted Provisions:
11 This bill:
12 . creates the Outdoor Recreation Office;
13 . establishes the purposes of the Outdoor Recreation Office;
14 . provides for the appointment of a director to administer the Outdoor Recreation
15 Office;
16 . establishes the duties of the director; and
17 . requires the director to submit an annual report to a legislative committee.

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. Section 63M-1-3201 is enacted to read:

34 63M-1-3201. Title.
35 This part is known as "Utah Outdoor Recreation Office Act."
36 Section 2. Section 63M-1-3202 is enacted to read:
37 63M-1-3202. Definitions.
38 As used in this part:
39 (1) "Director" means the director of the office.
40 (2) "Executive director" means the director of the Governor's Office of Economic
41 Development created in Section 63M-1-201 .
42 (3) "Office" means the Outdoor Recreation Office created in Section 63M-1-3204 .
43 Section 3. Section 63M-1-3203 is enacted to read:
44 63M-1-3203. Policy.
45 It is the declared policy of the state that outdoor recreation is vital to a diverse economy
46 and a healthy community.
47 Section 4. Section 63M-1-3204 is enacted to read:
48 63M-1-3204. Creation of office and director -- Purpose of office.
49 (1) There is created within the Governor's Office of Economic Development an
50 Outdoor Recreation Office.
51 (2) (a) The executive director shall appoint a director of the office.
52 (b) The director shall report to the executive director and may appoint staff.
53 (3) The purposes of the office are to:
54 (a) coordinate outdoor recreation policy, management, and promotion among state and
55 federal agencies and local government entities in the state;
56 (b) promote economic development by:
57 (i) coordinating with outdoor recreation stakeholders;
58 (ii) improving recreational opportunities; and
59 (iii) recruiting outdoor recreation business;
60 (c) recommend to the governor and Legislature policies and initiatives to enhance
61 recreational amenities and experiences in the state and help implement those policies and
62 initiatives;
63 (d) develop data regarding the impacts of outdoor recreation in the state; and
64 (e) promote the health and social benefits of outdoor recreation, especially to young
65 people.
66 Section 5. Section 63M-1-3205 is enacted to read:
67 63M-1-3205. Duties of director.
68 (1) The director shall:
69 (a) assure that the purposes outlined in Subsection 63M-1-3204 (3) are fulfilled; and
70 (b) organize and provide administrative oversight to the office staff.
71 (2) By following the procedures and requirements of Title 63J, Chapter 5, Federal
72 Funds Procedures Act, the office may:
73 (a) seek federal grants or loans;
74 (b) seek to participate in federal programs; and
75 (c) in accordance with applicable federal program guidelines, administer federally
76 funded outdoor recreation programs.
77 (3) For purposes of administering this part, the office may make rules in accordance
78 with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.
79 Section 6. Section 63M-1-3206 is enacted to read:
80 63M-1-3206. Legislative committee review.
81 Before November 1 of each year, the director shall submit an annual report to the
82 Economic Development and Workforce Services Interim Committee.
83 Section 7. Effective date.
84 If approved by two-thirds of all the members elected to each house, this bill takes effect
85 upon approval by the governor, or the day following the constitutional time limit of Utah
86 Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
87 the date of veto override.
