8 General Description:
9 This joint rules resolution enacts a joint legislative rule relating to circled legislation.
10 Highlighted Provisions:
11 This resolution:
12 . enacts a joint legislative rule providing that, subject to certain exceptions, a piece of
13 legislation that is circled for at least one hour per day during a cumulative total of
14 five days, during which both houses of the Legislature convene for legislative
15 business, shall be returned to the rules committee of the house in possession of the
16 piece of legislation.

23 Be it resolved by the Legislature of the state of Utah:
24 Section 1. JR4-4-110 is enacted to read:
25 JR4-4-110. Limitation on circling legislation.
26 (1) As used in this rule, "day" means any day during the general session that both
27 houses convene to conduct legislative business.
28 (2) Except as provided in Subsection (4), and notwithstanding the provisions of
29 SR4-6-202 or HR4-6-202, a piece of legislation shall be returned to the rules committee of the
30 house in possession of the piece of legislation at the end of the fifth cumulative day that the bill
31 has been circled for at least one hour during each of those days in the house in possession of
32 the bill.
33 (3) If, after a piece of legislation is returned to the rules committee under Subsection
34 (2), the bill is assigned to a committee or returned to the board and later circled, the counting of
35 the cumulative day total described in Subsection (2) starts over.
36 (4) Subsections (2) and (3) do not apply to:
37 (a) an appropriation bill described in Joint Rules, Title 4, Chapter 5, Part 2,
38 Appropriation Bills;
39 (b) a bond bill described in JR4-5-301;
40 (c) a bill with a fiscal note of $10,000 or more; or
41 (d) a piece of legislation if at least two-thirds of a constitutional majority of the house
42 in possession of the bill vote to allow the piece of legislation to remain circled longer than five
43 cumulative days.
