             8      General Description:
             9          This bill amends provisions that stagger the office terms of certain county officers.
             10      Highlighted Provisions:
             11          This bill:
             12          .    amends provisions that stagger the office terms of certain county officers; and
             13          .    makes technical corrections.
             14      Money Appropriated in this Bill:
             15          None
             16      Other Special Clauses:
             17          This bill provides an immediate effective date.
             18      Utah Code Sections Affected:
             19      AMENDS:
             20           17-16-6 , as last amended by Laws of Utah 2011, Chapter 154

             22      Be it enacted by the Legislature of the state of Utah:
             23          Section 1. Section 17-16-6 is amended to read:
             24           17-16-6. County officers -- Time of holding elections -- County commissioners --
             25      Terms of office.
             26          (1) Except as otherwise provided in an optional plan adopted under Chapter 52,
             27      Changing Forms of County Government:
             28          (a) each elected county officer shall be elected at the regular general election every four
             29      years in accordance with Section 20A-1-201 , except as otherwise provided in this title;


             30          (b) county commissioners shall be elected at the times, in the manner, and for the terms
             31      provided in Section 17-52-501 ; and
             32          (c) an elected officer shall hold office for the term for which the officer is elected,
             33      beginning at noon on the first Monday in January following the officer's election and until a
             34      successor is elected or appointed and qualified, except as provided in Section 17-16-1 .
             35          (2) (a) The terms of county officers shall be staggered in accordance with this
             36      Subsection (2).
             37          (b) Except as provided in Subsection (2)(c), in the 2014 general election:
             38          (i) the following county officers shall be elected to one six-year term and thereafter
             39      elected to a four-year term:
             40          (A) county treasurer;
             41          (B) county recorder;
             42          (C) county surveyor; and
             43          (D) county assessor; and
             44          (ii) all other county officers shall be elected to a four-year term.
             45          (c) If a county legislative body consolidates two or more county offices in accordance
             46      with Section 17-16-3 [on or after May 10, 2011], and the consolidated offices are on
             47      conflicting election schedules, the county legislative body shall pass an ordinance that sets the
             48      election schedule for the consolidated offices in a reasonable manner that staggers the terms of
             49      county officers as provided in this Subsection (2).
             50          Section 2. Effective date.
             51          If approved by two-thirds of all the members elected to each house, this bill takes effect
             52      upon approval by the governor, or the day following the constitutional time limit of Utah
             53      Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
             54      the date of veto override.
