7     LONG TITLE
8     General Description:
9          This bill modifies provisions of Title 35A, Chapter 4, Employment Security Act.
10     Highlighted Provisions:
11          This bill:
12          ▸     authorizes the Department of Workforce Services to waive the one-week waiting
13     period for unemployment benefits and provide an unemployed individual with a
14     benefit for that week if:
15               •     a state of emergency has been declared by the president of the United States or
16     the governor; or
17               •     the federal government has agreed to pay for the benefit.
18     Money Appropriated in this Bill:
19          None
20     Other Special Clauses:
21          This bill provides a special effective date.
22     Utah Code Sections Affected:
23     ENACTS:
24          35A-4-403.5, Utah Code Annotated 1953
25     

26     Be it enacted by the Legislature of the state of Utah:
27          Section 1. Section 35A-4-403.5 is enacted to read:
28          35A-4-403.5. Waiver of one-week waiting period during emergency.
29          For any week beginning on or after January 1, 2020, the department may waive the

30     one-week waiting period described in Subsection 35A-4-403(1)(d) and pay a benefit to an
31     unemployed individual for that week if:
32          (1) the unemployed individual otherwise qualifies for a benefit for that week; and
33          (2) (a) the president of the United States has issued an order declaring a national
34     emergency that is effective in the state during that week;
35          (b) the governor has issued an executive order declaring a state of emergency as
36     described in Title 53, Chapter 2a, Emergency Management Act, that is effective during that
37     week; or
38          (c) the federal government has agreed to reimburse the department for the cost of
39     paying the benefit for that week.
40          Section 2. Effective date.
41          If approved by two-thirds of all the members elected to each house, this bill takes effect
42     upon approval by the governor, or the day following the constitutional time limit of Utah
43     Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
44     the date of veto override.
