7 LONG TITLE
8 General Description:
9 This bill amends provisions of the code relating to the unveiling of the statue of Martha
10 Hughes Cannon in the United States Capitol and extends the repeal date of the Martha
11 Hughes Cannon Capitol Statue Oversight Committee.
12 Highlighted Provisions:
13 This bill:
14 ▸ removes a requirement that the statue of Martha Hughes Cannon be placed in the
15 National Statuary Hall;
16 ▸ removes a timing requirement for the unveiling of the statue of Martha Hughes
17 Cannon; and
18 ▸ extends the repeal date for the Martha Hughes Cannon Capitol Statue Oversight
19 Committee.

23 This bill provides a special effective date.

30 Be it enacted by the Legislature of the state of Utah:
31 Section 1. Section 36-31-104 is amended to read:
32 36-31-104. Committee duties.
33 (1) The committee shall:
34 (a) coordinate efforts to place a statue of Martha Hughes Cannon in the [National
35Statuary Hall in the] United States Capitol to replace the statue of Philo Farnsworth;
36 (b) ensure that efforts to place the statue of Martha Hughes Cannon conform with the
37 requirements of 2 U.S.C. Chapter 30, Subchapter V, Part D, Miscellaneous;
38 (c) represent the state in interactions with the following in relation to the placement of
39 the statue of Martha Hughes Cannon:
40 (i) the Joint Committee on the Library of Congress described in 2 U.S.C. Sec. 2132;
41 (ii) the architect of the capitol described in 2 U.S.C. Sec. 2132; and
42 (iii) any other federal entity;
43 (d) select a sculptor for the statue of Martha Hughes Cannon;
44 (e) ensure that the statue of Martha Hughes Cannon is created in marble or bronze, as
45 required under 2 U.S.C. Sec. 2131;
46 (f) approve the final design of the statue of Martha Hughes Cannon; and
47 [(g) ensure that the statue of Martha Hughes Cannon is unveiled in the National
48Statuary Hall in August of 2020, in commemoration of the month of the 100th anniversary of
49the ratification of the Nineteenth Amendment to the United States Constitution; and]
50 [(h)] (g) determine, in coordination with appropriate community leaders and local
51 elected officials, an appropriate location for placement of the statue of Philo Farnsworth that is
52 currently on display in the National Statuary Hall in the United States Capitol.
53 (2) The committee shall facilitate the creation of a nonprofit entity that is exempt from
54 federal income tax under Section 501(c), Internal Revenue Code, to:
55 (a) collect contributions to cover costs associated with:
56 (i) the creation and placement of the statue of Martha Hughes Cannon in the [National
57Statuary Hall in the] United States Capitol;
58 (ii) the removal of the statue of Philo Farnsworth that is currently on display in the
59 National Statuary Hall in the United States Capitol; and
60 (iii) the placement of the statue described in Subsection (2)(a)(ii) for display in a
61 location designated by the committee under Subsection (1)[(h)](g); and
62 (b) comply with the requirements of 2 U.S.C. Sec. 2132 regarding the cost of replacing
63 a state's statue in the National Statuary Hall.
64 Section 2. Section 36-31-105 is amended to read:
65 36-31-105. Martha Hughes Cannon Capitol Statue ownership.
66 The statue of Martha Hughes Cannon, along with all funds donated for its creation,
67 maintenance, and transportation, belong to Utah. The state is entitled to transfer the statue to
68 the United States Capitol for purposes of display [in the National Statuary Hall].
69 Section 3. Section 63I-1-236 is amended to read:
70 63I-1-236. Repeal dates, Title 36.
71 (1) Title 36, Chapter 17, Legislative Process Committee, is repealed January 1, 2023.
72 (2) Section 36-12-20 is repealed June 30, 2023.
73 (3) Title 36, Chapter 28, Veterans and Military Affairs Commission, is repealed
74 January 1, 2025.
75 (4) Section 36-29-105 is repealed on December 31, 2020.
76 (5) Section 36-29-106 is repealed June 1, 2021.
77 (6) Title 36, Chapter 31, Martha Hughes Cannon Capitol Statue Oversight Committee,
78 is repealed January 1, [2021] 2022.
79 Section 4. Effective date.
80 If approved by two-thirds of all the members elected to each house, this bill takes effect
81 upon approval by the governor, or the day following the constitutional time limit of Utah
82 Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
83 the date of veto override.
